`Pursuant to LCR 3(g)(1), the Puyallup Tribe of Indians hereby submits this notice of
`
`pending, related cases in the Western District of Washington.
`
`
`
`The first case, American Whitewater v. Electron Hydro, LLC, No. 2:16-cv-
`
`00047-JCC (W.D. Wash.), is also a case filed for violations of the Endangered Species Act.
`
`The case arises from similar facts and conduct of the Defendants, and alleges take of listed
`
`species in violation of the Endangered Species Act, 16 U.S.C. § 1538.
`
` The second related case, United States of America v. Electro Hydro, LLC, No. 2:20-
`
`cv-1746-RAJ (W.D. Wash.) is a case against Electron Hydro, LLC arising from the same
`
`facts and occurrences that occurred in July of 2020 at the Electron Facility during
`
`
`
`

`construction. The claims against Electron Hydro in United States v. Electron Hydro, LLC
`
`matter include claims for violations of the Clean Water Act as a result of the placement of turf
`
`and other unpermitted fill, and other unpermitted discharges, into the Puyallup River.
`
`Both related actions concern substantially the same defendants, property, and many of
`
`the same events. It appears that there would be an unduly burdensome duplication of labor
`
`and expense or the potential for conflicting results if this matter and the other matter involving
`
`claims under the Endangered Species Act, American Whitewater v. Electron Hydro, LLC, No.
`
`2:16-cv-00047-JCC (W.D. Wash.), were conducted before different judges.
`
