`Term “prediction/predicted/predicting/predict(s)" - independent claims1, 11 and
`20 and throughout the description
`The term "to predict" is defined in Merriam-Websteras "to declareorindicate in
`advance". In the context of the whole application and particularly in the context
`of independent claims 1, 11 and 20, it does not make any sense.-
`First a vibration signal is captured during movementof an implement. Soit
`means the movementis actually happening during the sensing. Then the signal
`is analysed and after that a prediction, a forecast for a future event, of a start
`time and endtime of the digging operation that already happened should be
`made.. Whereisthe logic in predicting how long a digging operation would be of
`a digging operation that already happened ? Onealready knowshowlong the.
`digging operation.was.
`The use of the term "predict"is veryy confusing andit results jina lack of clarity
`
`(Art. 6 PCT).

`
`Claims 1 and 11 - methods
`
`In claim 1, it is stated "providing the one or more features to a machine-learning
`model to generate a model output". Here it is understood that the machine-
`learningis trained in order to be able to generate a model output. Sothis
`method step implies that a training method of.a machine-learning model is de-
`fined.
`Howeverthe last step "predicting (...)" implies that the machine-learning model
`is used and its output is usedforfurther processing. So this method step implies
`that a method of using a machine-learning modelis defined.
`A training method of a machine-learning model anda methodof using a ma-
`chine-learning model are two different types of method and can notbe defined
`together without rendering the subject-matter of the claim unclear (Art. 6 PCT).
`
`The same argument appliesto the apparatus claim11 with the programmedin-
`
`structions corresponding to the method of claim 1.

`Claims 1 and 11 - Machine-learning model
`‘The machine--learning model in claims 1 and 11 are not clearly defined as no
`outputsis defined (the use of the general term "model output"is not considered
`to clearly define the ouput). Furthermore, the inputs are defined as "one or more
`features from a vibration signal", which is very broad and donot clearly defined
`the inputs. What are the "one or more features" ?
`It results in a lack ofclarity (Art. 6 PCT)

`Although claims 1 and 20 have beendrafted as separateindependentclaims,
`they appearto relate effectively to the same subject-matter and to differ from
`each other only with regard to the definition of the subject-matter for which pro-

`that subject-matter. The aforementioned claims therefore lack conciseness and
`as such do not meet the requirements of Article 6 PCT.
