`The Examining Attorney has refused to register Applicant’s mark on the basis

`in US. Registration Nos. 1795643 and 2024322 as to be likely to cause confusion,
`
`mistake or to deceive consumers pursuant to Section 2(d) of the Trademark Act.
`
`Application Serial Nos. 74-684191 and 75-226388 are still pending and therefore will
`
`not be addressed in the present Response. For the reasons discussed below,
`
`Applicant respectfully disagrees and requests that the refusal be withdrawn and the
`
`mark be forwarded for publication in the Official Gazette.
`
`The Examining Attorney, referring to Visual Information Institute Inc. V.
`
`Vicgn Industries, Inc., 209 U.S.P.Q. 179 (TTAB 1980), has correctly indicated that the
`
`issue in determining the likelihood of confusion is whether or not the marks in
`
`question create the same overall impression. The "overall impression” of
`
`Applicant’s mark "VISIONzFLASHPOINT” is simply not likely to cause confusion
`
`with the two identical registered marks referred to above, one of which is currently
`

`owned by the Applicant. It is well established that marks must be examined as a
`
`whole and not dissected into their component parts when determining likelihood
`
`of confusion.
`

`Duluth News Tribune V. Mesabi Publ. Co. 38 U.S.P.Q. 2d 1937 (8th Cir. 1996).

`(emphasis added) Moreover, simply because the present mark contains in part a
`
`whole of another’s mark does not mean that it is likely to cause confusion.

`In re Merchandising Motivation, Inc. 184 U.S.P.Q. 364 (T.T.A.B. 1974) where it was

`held that there is no absolute rule that no one has the right to incorporate the total
`
`mark of another as part of one’s own mark: MMI MENSWEAR not confusingly

`similar to MEN’S WEAR; and In Re Ferraro 178 U.S.P.Q. 167 (C.C.P.A.1973) where

`TIC TAC was found to be not confusingly similar to TIC TAC TOE). While

`"VISIONzFLASHPOINT" incorporates the word “FLASHPOINT” which is

`previously registered to more than one registrant, taken as a Whole it’s overall
`

`Applicant’s mark is particularly distinct when connected with its other
`
`“family” of registered marks all beginning with the prefix “VISION” followed
`
`by the colon punctuation mark. Applicant’s other registered trademarks

`Finally, Applicant is the owner of one of the two cited registrations.

`Further, of the two registrations cited, the Applicant's registration shows use
