`This letter responds to the applicant's communication filed on February 28, 2001.

`In its response, the applicant submitted arguments regarding the refiisal to register under Section
`2(e)(4), the name and citizenship of its general partner, promotional materials regarding the goods,
`and an amended identification of goods.
`
`The refusal to register under Section 2(e)(4) is withdrawn. The identity of the general partner and
`information regarding the goods has been made of record. For the reasons noted below,
`the
`amended identification of goods is unacceptable. The requirement for an acceptable identification
`of goods is maintained and made FINAL.
`
`The amended identification of goods is unacceptable because it does not identify the goods with
`sufficient specificity. The wording "gearing systems" in the amended identification of goods is
`unacceptable as indefinite. As noted in the Office action issued August 31, 2000, the applicant
`must use the common commercial names for the goods, be as complete and specific as possible and
`avoid the use of indefinite words and phrases. If the applicant chooses to use indefinite terms, such
`as "systems,” those words must be followed by the word "namely" and the goods listed by their
`common commercial names. TMEP sections 804 and 804.08(c).

`The assigned examining attorney has reviewed the referenced application and determined the

`The examining attorney refuses registration on the Principal Register because the mark is primarily
`merely a surname. Trademark Act Section 2(e)(4), 15 U.S.C. Section 1052(e)(4); TMEP section
`1211. The examining attorney must consider the primary significance of the mark to the purchasing
`public to determine whether a term is primarily merely a surname. In re Kahan & Weisz Jewelry Mfg.
`Corp, 508 F.2d 831, 184 USPQ 421 (CCPA 1975). Please see the attached evidence from a search of
`the PhoneDisc database, showing a total of 15,376 residential listings for the surname “Browning,”
`thus establishing the surname significance of the mark.
`
`The applicant has indicated use of the mark for almost 40 years as well as ownership of the same
`mark for related goods. An applicant may register a surname under Trademark Act Section 2(f), 15
`U.S.C. Section 1052(t), by establishing acquired distinctiveness. The applicant may present any of
`the following to establish distinctiveness.
