`This letter responds to the applicant's communication filed on December 17, 1998.

`In the initial Office Action dated June 17, 1998, the examining attorney refiised registration of the
`proposed mark under Section 2(e)( 1) of the Trademark Act because it merely describes the goods.
`On December 17, 1998,
`the applicant responded by filing an amendment to allege use and
`amending the application to assert acquired distinctiveness under Section 2(0 of the Trademark
`Act. Upon firrther consideration the examining attorney has determined the following.

`Proposed Mark is Refused Under Section Zleull Because the Wording is Generic
`After further review, despite the applicant’s assertion of acquired distinctiveness under Section
`2(f), registration of the term “STEELHEAD” is refiised under Section 2(e)(1) of the Trademark
`Act, 15 U.S.C. Section 1052(e)(1); TMEP section 1209 et seq, because the examining attorney has
`determined that the proposed subject matter is generic when used in connection with golf clubs.
`
`In review, the applicant has applied to register the proposed term “STEELHEAD” as a mark in
`connection with “golf clubs and golf club head covers.” The term “steelhead” is simply a term
`used to designate a particular genre or type of golf clubs that contain heads made of the metal steel.

`These stories clearly show that the term “steelhead” and variations thereof are routinely used to
`designate golf clubs with steel heads. Thus, to allow the applicant to obtain exclusive rights in the
`term “steelhead” would certainly deprive competitors and others from the right to use the common
`term “steelhead” in connection with golf clubs containing steel heads. Accordingly, for the reasons
`stated above and those contained in the original Office Action, registration of the proposed subject
`matter is refused registration because the term is generic for the goods (i.e., golf clubs).
`
`The applicant should also note the following.

`Even if the term “Steelhead” is found capable of registration (i.e., not generic), the examining
`attorney still refuses registration on the Principal Register under Trademark Act Section 2(e)(1), 15

`Under Section 2(f), the applicant has the burden of proving the distinctiveness of the mark by clear
`and convincing evidence. This has not been done in the present case. While the applicant has
`submitted extensive advertising figures, etc;, there is no evidence in the record that the consuming
`public associates the term “Steelhead” as an exclusive source indicator for the applicant’s golf
`clubs. However, the applicant should note that as discussed above, because the examining attorney
`has determined that the mark is generic, it is very doubtful that submission of any amount and/or
`quality of evidence will convince the examining attorney that acquired distinctiveness has been
`achieved. Additionally, the fact that an applicant may be the first and only user of a merely
`descriptive or generic designation does not justify registration if the term is merely descriptive. In
