`
`n the instant case, applicant seeks registration of the copyleft symbol for “Advertising, marketing and promotional services related to all
`industries for the purpose of facilitating networking and socializing opportunities for business purposes; Business consultation services to assist
`non-profit organizations in planning, managing, and conducting fund raising activities via a global computer network; Business networking;
`Business networking of peer to peer learning groups of high net worth individuals; General business networking referral services, namely,
`promoting the goods and services of others by passing business leads and referrals among group members; On-line advertising on computer
`communication networks; On-line business networking services; Promoting the goods and services of others via a global computer network;
`Providing a web site which features advertisements for the goods and services of others on a global computer network; Providing business
`information, also via internet, the cable network or other forms of data transfer; Providing information about commercial business and
`commercial information via the global computer network; Providing information about the goods and services of others via the global computer
`network.” (cid:160) The applied-for mark is a symbol representing copyleft, which is defined as “the copyright notice and General Public License
`applying to the works of the Free Software Foundation, granting reuse and reproduction rights to everyone.(cid:160) Typically copyrights take away
`freedoms; copyleft preserves them. It is a legal instrument that requires those who pass on a program to include the rights to use, modify, and
`redistribute the code; the code and the freedoms become legally inseparable. The copyleft used by the GNU Project combines a regular copyright
`notice and the "GNU General Public License" (GPL). The GPL is a copying license which basically says that you have the aforementioned
`freedoms. The license is included in each GNU source code distribution and manual.” (cid:160) Please see the attached definition from The Free On-Line
`Dictionary of Computing, © 1993-2007 Denis Howe.(cid:160) Further, the on-line dictionary from NetLingo clearly displays the applicant’s applied-for
`mar, the left-facing copyright symbol, as the copyleft symbol.(cid:160) Please see the attached definition and use of the mark.(cid:160) Therefore, the applicant’s
`mark merely describes a feature of the identified services, namely, that the service owner is granting reuse and reproduction rights to everyone.(cid:160)
`Also attached is website evidence from six websites showing the common use of the applied-for mark for a particular type of copyright
`protection.(cid:160)
`Therefore, the proposed mark merely describes a main feature of the applicant’s services and registration on the Principal Register must be
`refused under Trademark Act Section 2(e)(1).
`

`
`pplicant must respond to the requirement(s) set forth below.
`
`(cid:160)P
`
`ROCEDURAL ISSUES
`
`(cid:160)M
`
`ark Description
`
`(cid:160)A
`
`pplicant provided the following mark description:(cid:160) “The mark consists of The Copyleft symbol represents the antithesis of the copyright mark.
`Furthermore, we will use it as our logo for a copyleft marketplace where social entrepreneurs from around the world can share their ideas for
`creating change. through a copyleft licensing scheme, the owner of the copylefted entity gives every person who receives a copy of a work
`permission to reproduce, adapt or distribute the work as long as any resulting copies or adaptations are also bound by the same copyleft licensing
`scheme. Once we trademark the logo we will copyleft it to the world. The reason we want to trademark it is to ensure that no one else can make
`
`it exclusively theirs.” (cid:160)(cid:160)
`
`The description must describe only the features of the mark and not the purpose, the use, etc. of the mark.(cid:160) Therefore, the description of the mark
`uses broad, vague language that does not accurately describe the applied-for mark.(cid:160) Applications for marks not in standard characters must
`include an accurate and concise description that identifies all literal elements as well as any design elements in the mark.(cid:160) See 37 C.F.R. §2.37;
`
`TMEP §§808 et seq.(cid:160)(cid:160)
`
`Applicant must submit a concise description of the mark.(cid:160) 37 C.F.R. §2.37; see TMEP §§808 et seq.(cid:160) The following is suggested:
`
`The mark consists of a left-facing letter “C” within in a circle. (cid:160)(cid:160)
`
`Explanation of Mark’s Significance Required
`
`(cid:160)A
`
`pplicant must specify whether the mark has any significance in the advertising, marketing, promotional, or business trade or industry or as
`applied to the goods/services described in the application.(cid:160) See 37 C.F.R. §2.61(b); TMEP §§808.01(c), 814.
`
`(cid:160)R
`
`ESPONSE TO OFFICE ACTION
`
`(cid:160)T
`
`here is no required format or form for responding to an Office action.(cid:160) The Office recommends applicants use the Trademark Electronic
`Application System (TEAS) to respond to Office actions online at http://www.uspto.gov/teas/index.html.(cid:160) However, if applicant responds on

`
`paper via regular mail, the response should include the title “Response to Office Action” and the following information: (cid:160) (1) the name and law
`office number of the examining attorney, (2) the serial number and filing date of the application, (3) the mailing date of this Office action, (4)
`applicant’s name, address, telephone number and e-mail address (if applicable), and (5) the mark. (cid:160) 37 C.F.R. §2.194(b)(1); TMEP §302.03(a).
`
`(cid:160)T
`
`he response should address each refusal and/or requirement raised in the Office action.(cid:160) If a refusal has issued, applicant can argue against the
`refusal; i.e., applicant can submit arguments and evidence as to why the refusal should be withdrawn and the mark should register.(cid:160) To respond to
`requirements, applicant should set forth in writing the required changes or statements and request that the Office enter them into the application
`
`record.(cid:160)(cid:160)
`
`The response must be personally signed or the electronic signature manually entered by applicant or someone with legal authority to bind
`applicant (i.e., a corporate officer of a corporate applicant, the equivalent of an officer for unincorporated organizations or limited liability
`company applicants, a general partner of a partnership applicant, each applicant for applications with multiple individual applicants).(cid:160) TMEP

`A play on the word "copyright" this is the practice ol’ using copyright law to remove restrictions on distributing copies and
`versions ofa work and requiring thatthe same freedoms be preserved in modified versions. In the online world. it is a form of
`licensing and may be used to modify copyrights for works such as computer sofiware. documents. music, and art. The main elfect is that
`through a "copylefi" licensing scheme, an author gives every person who receives a copy of a work permission to reproduce. adapt, or
`distribute the work as long as any resulting copies or adaptations are also bound by the same copylett licensing scheme. Similar licenses
`are available through Creative Commons [called Share-alike}; see the E definition for GPL a widely used and originating copylefl license.
`
`The Copyleft symbol above is the "reversed c in a full circle" and is the copyright symbol turned in the lefi direction. (Unlikethe copyright
`symbol it has no legal meaning.)
