`
`The assigned examining attorney has reviewed the referenced application and determined the following.
`
`No Conflicting Marks Noted
`The examining attorney has searched the Office records and has found no similar registered or pending
`mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d).
`TMEP section 704.01.
`
`Mark is Merely Descriptive
`The examining attorney refuses registration on the Principal Register because the proposed mark merely
`describes the goods/services. Trademark Act Section 2(e)(l), 15 U.S.C. §1052(e)(1); TMEP §§1209 et
`seq.
`
`A mark is merely descriptive under Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1), if it

`feature, purpose or use of the relevant
`fianction,
`describes an ingredient, quality, characteristic,
`goods/services. In re Gyulay, 820 F.2d 1216, 3 USPQ2d 1009 (Fed. Cir. 1987); In re Bed & Breakfast
`Registry, 791 F.2d 157, 229 USPQ 818 (Fed. Cir. 1986); In re MetPath Inc., 223 USPQ 88 (TTAB
`1984); In re Bright-Crest, Ltd., 204 USPQ 591 (TTAB 1979); TMZEP §1209.01(b). In this case, the
`applicant has applied for the proposed mark “POCKET-STROBE” The term “POCKET” refers to any
`items that can be placed in a person’s pocket. The term “STROBE” is a common abbreviation for
`stroboscope. Please see the definitions below. As the applicant’s specimen states, “The Pocket—Strobe
`never needs to be hand carried. It fits in a pocket or can be worn on a belt or in its optional holster.”
`Therefore, the mark is merely descriptive under Section 2(e)(1).

`
`Requirement for Information
`The examining attorney requires information about the goods to determine whether all or part of the
`mark is merely descriptive as applied to the goods. 37 CFR. §2.6l(b); TMEP §§8l4 and l402.01(d).
`The applicant must provide product information for the goods. This may take the form of a fact sheet,
`instruction manual, or advertisement.
`If unavailable, the applicant should submit the information for
`goods of the same type, explaining how its own product will differ. Ifthe goods feature new technology
`and no competing goods are available, the applicant must provide a detailed factual description of the
`goods. Please specifically state ifthe stroboscopes can be placed in one ’sp0cket.
`
`12/3/O2
`
`
`
`UNITED STATES DEPARTMT T OF COMIVJERCE
`
`
`In all cases, the submitted factual information must make clear how the goods operate, its salient
`features, and its prospective customer and/or channel of trade. This information is not readily available
`to the examining attorney, and is pertinent to the descriptiveness determination. Conclusory statements
`from the applicant or its attorney regarding the descriptiveness standard will not be sufficient to meet
`this requirement for information.
`
`Trademark Rule 2.61(b) states "The examiner may require the applicant to furnish such information and
`exhibits as may be reasonably necessary to the proper examination of the application". The Trademark
`Trial and Appeal Board has upheld a refusal of registration based on the applicant's failure to provide
`information requested under this rule. In re Babies Beat Inc., 13 USPQ2d 1729 (TTAB 1990)(failure to
`submit patent information regarding configuration).
`
`Acquired Distinctiveness Under Section 2(f) Possible
`The application indicates use of the mark for a significant time. Therefore, the applicant may amend to
`seek registration under Trademark Act Section 2(f),
`15 U.S.C. §l052(f), based on acquired
`distinctiveness. Ifthe applicant chooses to do so by using the statutory suggestion of five years of use as
`proof of distinctiveness, the applicant should submit a claim of distinctiveness that reads as follows, if
`accurate.
`
`The mark has become distinctive of the goods/services through the applicant ‘s substantially
`exclusive and continuous use in commerce for at least the five years immediately before the date
`of this statement.
`
`The applicant must provide this statement supported by an affidavit or a declaration under 37 CPR.
`§2.20. 37 C.F.R. §2.41(b); TMEP §l2l2.05(d).
`
`The following sample declaration is provided below:
`
`The undersigned, being hereby warned that willful false statements and the like so made are punishable
`by fine or imprisonment, or both, under 18 U.S.C. §l00l, and that such willful false statements may
`jeopardize the validity of the application or any resulting registration, declares that he/she is properly
`authorized to execute this application on behalf of the applicant; he/she believes the applicant to be the
`owner of the trademark/service mark sought to be registered, or, if the application is being filed under 15
`U.S.C. §§lO51(b), 1126(d) or 1126(e), he/she believes the applicant to be entitled to use such mark in
`commerce; to the best of his/her knowledge and belief no other person, firm, corporation, or association
`has the right to use the mark in commerce, either in the identical form thereof or in such near
`resemblance thereto as to be likely, when used on or in connection with the goods/services of such other
`person, to cause confusion, or to cause mistake, or to deceive; and that all statements made of his/her
`own knowledge are true and all statements made on information and belief are believed to be true.
