`“THE CHRISTMAS CHANNEL” immediately conveys to consumers that the applicant’s cable television broadcasting services will feature
`Christmas-themed programming.(cid:160) (See attached definitions.)(cid:160)(cid:160) The examining attorney notes that the applicant has conceded in its response that
`its broadcasts will contain Christmas themed media and that portions of its broadcasts will feature Christmas programs and Christmas themed

`A mark that combines descriptive terms may be registrable if the composite creates a unitary mark with a separate, nondescriptive meaning.(cid:160) In
`re Colonial Stores, Inc., 394 F.2d 549, 157 USPQ 382 (C.C.P.A. 1968) (holding SUGAR & SPICE not to be merely descriptive of bakery
`products).(cid:160) However, the mere combination of descriptive words does not automatically create a new nondescriptive word or phrase.(cid:160) E.g., In re

`(cid:160)(cid:160)(cid:160) At KESZ-FM (99.9), the Valley's only all-holiday station, program director Kevin Gossett starts planning seasonal music in June, readying to

`go on air in mid-November. But he's not looking for new music as much as a good mix of what he's got.

`(cid:160)(cid:160) (cid:160) He listens to new holiday albums, this year adding a few tracks from Hall & Oates' Home for Christmas, but he doesn't go out of his way.
`(cid:160)(cid:160)(cid:160) "Christmas is about nostalgia and family and comfort," he says. "So the questions we ask ourselves are, 'Is this song going to make someone
`
`feel nostalgic?' 'Is it going to remind them of their childhood?' and if the answer is no, it's not going to be on the radio."

`(cid:160)(cid:160)(cid:160) He says the (cid:160) Christmas programming(cid:160) would be fine even if he didn't add another new song for 10 years.
`(cid:160)(cid:160)(cid:160) "Why does anybody need to break into the canon?" Gossett asks. "The Christmas songs of my childhood are those of my parents' childhood and

`possibly my grandparents', and this might be the only time of the year that we all agree on music."
