`LIKELIHOOD OF CONFUSION
`
`The examining attorney refuses registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d), because the applicant’s mark, when used
`on or in connection with the identified goods/services, so resembles the mark in U.S. Registration No. 3000436 to be likely to cause confusion,
`or to cause mistake, or to deceive.  TMEP §§1207.01 et seq.  See the enclosed registration.
`
`Trademark Act Section 2(d) bars registration where an applied-for mark so resembles a registered mark that it is likely, when applied to the
`goods and/or services, to cause confusion, mistake or to deceive the potential consumer as to the source of the goods and/or services.  TMEP
`§1207.01.  The Court in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973), listed the principal factors to
`consider in determining whether there is a likelihood of confusion.  Among these factors are the similarity of the marks as to appearance, sound,
`meaning and commercial impression, and the relatedness of the goods and/or services.  The overriding concern is to prevent buyer confusion as
`to the source of the goods and/or services.  In re Shell Oil Co., 992 F.2d 1204, 1208, 26 USPQ2d 1687, 1690 (Fed. Cir. 1993).  Therefore, any
`doubt as to the existence of a likelihood of confusion must be resolved in favor of the registrant.  In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463,
`6 USPQ2d 1025 (Fed. Cir. 1988); Lone Star Mfg. Co. v. Bill Beasley, Inc., 498 F.2d 906, 182 USPQ 368 (C.C.P.A. 1974).

`Taking into account the relevant Du Pont factors, a likelihood of confusion determination in this case involves a two-part analysis.  First, the
`marks are compared for similarities in appearance, sound, connotation and commercial impression.  In re E .I. du Pont de Nemours & Co., 476
`F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973).  Second, the goods or services are compared to determine whether they are similar or related or
`whether the activities surrounding their marketing are such that confusion as to origin is likely.  In re National Novice Hockey League, Inc., 222
`USPQ 638 (TTAB 1984); In re August Storck KG, 218 USPQ 823 (TTAB 1983); In re Int’l Tel. and Tel. Corp. , 197 USPQ 910 (TTAB 1978);
`Guardian Prods. Co., v. Scott Paper Co., 200 USPQ 738 (TTAB 1978); TMEP §§1207.01 et seq.
`
`Comparison of the Marks
`
`The marks are compared for similarities in sound, appearance, meaning or connotation.  In re E .I. du Pont de Nemours & Co., 476 F.2d 1357,
`177 USPQ 563 (C.C.P.A. 1973).  Similarity in any one of these elements may be sufficient to find a likelihood of confusion.  In re White Swan
`Ltd., 8 USPQ2d 1534, 1536 (TTAB 1988); In re Lamson Oil Co., 6 USPQ2d 1041, 1043 (TTAB 1987); In re Mack, 197 USPQ 755 (TTAB
`
`1977); TMEP §1207.01(b).  
`
`Applicant’s mark “Better sleep means better health” is a slogan which differs from Registrant’s mark only by the format, and not in the
`impression that it conveys.  Applicant’s mark expressly states what Registrant’s mark suggests.
`  Regarding the issue of likelihood of confusion,
`the question is not whether people will confuse the marks, but whether the marks will confuse people into believing that the goods they identify
`come from the same source.  In re West Point-Pepperell, Inc., 468 F.2d 200, 175 USPQ 558 (C.C.P.A. 1972).  For that reason, the test of
`likelihood of confusion is not whether the marks can be distinguished when subjected to a side-by-side comparison.  The question is whether the
`marks create the same overall impression.  Recot, Inc. v. M.C. Becton, 214 F.2d 1322, 54 USPQ2d 1894, 1890 (Fed. Cir. 2000); Visual
`Information Inst., Inc. v. Vicon Indus. Inc., 209 USPQ 179 (TTAB 1980).  The focus is on the recollection of the average purchaser who
`normally retains a general rather than specific impression of trademarks.  Chemetron Corp. v. Morris Coupling & Clamp Co., 203 USPQ 537
`(TTAB 1979); Sealed Air Corp. v. Scott Paper Co., 190 USPQ 106 (TTAB 1975); TMEP §1207.01(b). Hence, the differences between the two,
`namely, the appearance and use of a period instead of the word “means” fails to sufficiently distinguish the marks particularly because each
`
`imparts the same connotation.  
`
`Comparison of the Goods and Services
`
`Registrant’s services are “medical services.” Applicant’s goods are “apparatus for magnet therapy,” which apparatus is further discussed in
`applicant’s web page as directed to sleep, specifically “that sleeping within my patented, extremely low intensity EarthPulse® pulsed electro
`magnetic field, results in deeper, more restful sleep and highly advanced recovery which in turn results in substantially enhanced human
`performance.”   See attached copy, and Applicant’s specimen of use of the EarthPulse controller of record.   Applicant further refers to peer
`reviewed pulsed magnetic therapy research in its web page, and indicates in a letter to Google that “My trademark EarthPulse® application #
`
`78178243 was filed by me on 10/24/02 for medical devices.”   
`
`Consistent with Applicant’s reference to medical studies of magnetic therapy, further attached Internet evidence shows that sleep disorders are
`treated by regional U.S. health care providers offering medical services, and that a major U.S. health insurer discusses magnetic therapy in an
`
`online article.  
`
`Hence, the Registrant’s and the Applicant’s goods and services are closely related, each marketed in the field of medical services and health
`
`care, and directed to a target consumer comprising purchasers who would seek to alleviate poor sleep or sleep disorders.  
`
`Hence, the overall similarities between the Registrant’s and Applicant’s marks and goods and/or services, and the commercial impressions that
`they create, are greater than the differences, and refusal of registration of Applicant’s mark under Section 2(d) is appropriate.
`
`Applicant should note the following additional ground for refusal.
`
`SECTION 2(E)(1) - DESCRIPTIVE REFUSAL
`
`Registration is refused because the proposed mark merely describes a purpose of applicant’s goods.   Trademark Act Section 2(e)(1), 15 U.S.C.
`§1052(e)(1); TMEP §§1209 et seq.
`

` mark is merely descriptive under Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1), if it describes an ingredient, quality, characteristic,
`function, feature, purpose or use of the relevant goods and/or services.  In re Gyulay, 820 F.2d 1216, 3 USPQ2d 1009 (Fed. Cir. 1987);  In re Bed
`& Breakfast Registry, 791 F.2d 157, 229 USPQ 818 (Fed. Cir. 1986); In re MetPath Inc., 223 USPQ 88 (TTAB 1984); In re Bright‑Crest, Ltd.,
`204 USPQ 591 (TTAB 1979); TMEP §1209.01(b).  A mark that describes an intended user of a product or service is also merely descriptive
`within the meaning of Section 2(e)(1).  Hunter Publishing Co. v. Caulfield Publishing Ltd., 1 USPQ2d 1996 (TTAB 1986); In re Camel Mfg.
`Co., Inc., 222 USPQ 1031 (TTAB 1984); In re Gentex Corp., 151 USPQ 435 (TTAB 1966).

` mark that combines descriptive terms may be registrable if the composite creates a unitary mark with a separate, nondescriptive meaning. 
`However, if each component retains its descriptive significance in relation to the goods or services, the combination results in a composite that is

`itself descriptive.  In re Tower Tech, Inc., 64 USPQ2d 1314 (TTAB 2002) (SMARTTOWER merely descriptive of “commercial and industrial
`cooling towers and accessories therefor, sold as a unit”); In re Sun Microsystems Inc., 59 USPQ2d 1084 (TTAB 2001) (AGENTBEANS merely
`descriptive of computer software for use in development and deployment of application programs on global computer network); In re Putman
`Publishing Co., 39 USPQ2d 2021 (TTAB 1996) (FOOD & BEVERAGE ONLINE held to be merely descriptive of news and information service
`for the food processing industry); In re Copytele Inc., 31 USPQ2d 1540 (TTAB 1994) (SCREEN FAX PHONE merely descriptive of “facsimile
`terminals employing electrophoretic displays”); In re Entenmann’s Inc ., 15 USPQ2d 1750 (TTAB 1990), aff’d per curiam, 928 F.2d 411 (Fed.
`Cir. 1991) (OATNUT held to be merely descriptive of bread containing oats and hazelnuts).
`
`Here, applicant’s web page states “you've got a pretty good chance of improving your quality of life through better sleep.   Better Sleep Means
`Better Health® and sleeping in my new digitally sequenced pulsed electromagnetic field will not only neutralize your sleep deficit, but greatly
`improve your daytime focus and massively increase your stamina and strength.”   Applicant’s own use of “better sleep means better health”   in
`the advertising, despite its capitalization and improper use of the registration symbol, conveys the message that a purpose of sleeping in an
`electromagnetic field means better health, largely because it is a grammatically correct usage in Applicant’s sentence.
`
`This use is entirely consistent with two attached articles from About.com and an independent health network that entitle their articles “Better
`sleep means better health.”   This phrase is immediately perceived as informational, and would also be similarly perceived by a consumer as
`being a purpose of the Applicant’s apparatus for magnetic therapy during sleep.
`
`Hence, taken as a whole, the proposed mark “Better Sleep Means Better Health” merely describes the purpose of Applicant’s device.
`Accordingly, refusal on grounds that the mark is merely descriptive under Section 2(e)(1) is appropriate.
`
`Although the trademark examining attorney has refused registration, applicant may respond to the refusal to register by submitting evidence and
`arguments in support of registration.
`
`If applicant chooses to respond to the refusal(s) to register, then applicant should also note the following.
`
`IMPROPER USE OF REGISTRATION NOTICE
`
`The specimen shows use of the federal trademark registration symbol ® with the mark; however, Office records do not show that the mark is
`registered.  Applicant may not use the federal registration symbol until a mark is registered in this Office.  After registration of the mark,
`applicant may then use the symbol but only with the specific goods or services listed in the registration.  TMEP §§906 and 906.02.
`
`COMMENTS
`
`Please note that there is no required format or form for responding to this Office action.  However, applicant should include the following
`information on all correspondence with the Office:  (1) the name and law office number of the examining attorney; (2) the serial number of this
`application; (3) the mailing date of this Office action; and, (4) applicant's telephone number.

`When responding to this Office action, applicant must make sure to respond in writing to each refusal and requirement raised.  If there is a
`refusal to register the proposed mark, then applicant may wish to argue against the refusal, i.e., explain why it should be withdrawn and why the
