`PECIMEN REQUIRED
`The specimen is not acceptable because it does not show the applied-for mark in use in commerce.(cid:160) An application based on Trademark Act
`Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each class of services.(cid:160) Trademark Act Sections 1
`
`and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).(cid:160)(cid:160)

`The specimen consists of a logo that is presumably used as a banner atop the applicant’s website.(cid:160) However, it is not acceptable as evidence of
`actual service mark use because it does not evidence use on or in connection with the services.(cid:160) The specimen fails to show a nexus between the
`
`mark and the identified services.(cid:160) Thus, it fails to show proper use of the applied-for mark in the sale or advertising of the services.(cid:160)(cid:160)

`Therefore, applicant must submit the following:
