`Preliminary Response with Reservation ofRights
`
`The USPTO suggests that it will refuse registration of Applicant’s mark, ICONIC FITNESS, “because
`
`of a likelihood of confusion with four registered marks. “[T]he question of confusion is related not to
`
`the nature of the mark but to its effect ‘When applied to the goods of the applicant.” In re E. I. du Pont
`
`de Nemours & Co., 476 F.2d 1357, 1360, 177 USPQ 563, 566 (C.C.P.A. 1973). The United States
`
`Court of Customs and Patent Appeals listed thirteen factors to weigh in the likelihood of confusion
`
`analysis and stated that all of the factors must be considered “when of record.” Id. at 1361. The
`
`Examining Attorney has indicated that similarity of the marks, similarity of the goods and/or services,
`
`and similarity of trade channels of the goods and /or services weigh against the registration of
`
`Applicant’s mark. However, Applicant respectfully asserts that when all factors are Weighed, the
`
`
`
`majority weighs against the existence of a likelihood of confusion.
`
`(I) Similarity of Conflicting Designations
`
`The first factor is the similarity of the conflicting designations, including in their appearance, sound,
`
`meaning or connotation, and commercial impression. In re E. I. du Pont de Nemours & Ca, 476 F.2d
`
`1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973). A similar phrase found in two marks is not
`
`dispositive of a confusing similarity between the marks when the marks give off different commercial
`
`expressions. See Kellogg Ca. V. Pack’em Enterprises, Inc, 951 F.2d 330 (Fed. Cir. 1991). When
`
`Applicant’s mark (ICONIC FITNESS), and the cited registrations are compared; the marks give off
`
`different commercial expressions. The cited registrations either have no additional elements or have
`
`elements that narrow the commercial impression. The Applicant’s mark includes the additional term
`
`“FITNESS.” This additional term suggests that the goods are fitness related, thus giving off a
`
`commercial expression that is fitness related. The Examining Attorney has not provided evidence that
`
`the cited registrations give off a physical fitness related commercial impression. When the Applicant’s
`
`mark is viewed in its entirety, it is very difficult to establish that there is an association between
`
`Applicant’s physical fitness training and fitness related clothing and the goods offered under the cited
`
`registrations.
`
`Visually, the phrase ICONIC FITNESS is easily distinguished from the cited registration. Applicant’s
`
`mark is a uniquely styled “word & design trademark.” The applied for mark (with its style and design
`
`elements) is significantly different from the cited registrations. The two marks give distinctly different
`
`commercial impressions and visual representations. The Applicant’s mark incorporates design
`
`elements and the cited registrations do not. Applicant’s mark does not cover the same goods as the
`
`
`
`cited registrant. These differences create a substantially different commercial impression. For at least
`
`these reasons, Applicant asserts that the mark ICONIC FITNESS is significantly different than the
`
`cited registrations. This factor weighs in Applicant’s favor.
`
`(2) Similarity or Dissimilarity and the Nature of the Goods or Services
`
`The second factor is the similarity or dissimilarity and the nature of the goods or services as described
`
`in an application or registration or in connection with a prior use of the mark. In re E. I. du Pom‘ de
`
`Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973). Applicant’s class 025
`
`goods are for clothing, and two of the cited registrations also cover clothing. However, App1icant’s
`
`clothing is uniquely directed at physical fitness and personal training.
`
`Applicant’s class 041 services are not similar to the cited registrations because none of the services in
`
`the cited registrations identify personal training or physical fitness training in the applications.
`
`Therefore, this factor weighs in Applicant’s favor.
`
`(3) Similarity or Dissimilarity ofEstablished Likely to Continue Trade Channels
`
`The third factor is the similarity or dissimilarity of established, likely—to—continue trade channels. In re
`
`E. I. du Pont de Nemours & Co., 476 F.2d at 1361, 177 USPQ at 567. This factor heavily weighs
`
`against a finding of a likelihood of confiision. The Applicant maintains exclusive control over how his
`
`products and services reach trade channels. Applicant asserts that it is unlikely that consumers for the
`
`goods/services offered under the cited registrations will have a mistaken interaction with his service.
`
`The Examining Attorney also has not identified the trade channels for the cited registrations. It being
`
`unclear as to the Registrants’ trade channels, this factor either weighs against the existence of a
`
`
`
`likelihood of confusion or is neutral.
`
`(4) Conditions Upon Sales Are Made
`
`The fourth factor is the conditions under which and buyers to whom sales are made (i.e. impulse V.
`
`careful). Id. Consumers interested in Applicant’s goods/ services will contact the Applicant directly, as
`
`it offers direct personal services. Furtherrnore, its goods are directly offered as an extension of the
`
`Applicant’s class 41 services. Applicant controls and is directly engaged in the sale of its
`
`goods/services. Applicant’s involvement I sales is so direct, confusion amongst the cited registrations
`
`is unlikely. This factor weighs heavily against a likelihood of confusion between these two marks.
`
`(5) Fame of the Prior Mark
`
`The fifth factor is the fame of the prior mark (e. g., sales, advertising, length of use, etc). 101. There is
`
`no evidence that the prior marks are famous, this factor Weighs against a likelihood of confusion.
`
`(6) Number and Nature ofSimilar Marks in Use on Similar Goods
`
`The sixth factor is the number and nature of similar marks in use in connection with similar services.
`
`Id. In this case, the USPTO has not made any assertions as to the number and nature of marks used in
`
`connection with classes 025 or 041. However, different owners own some of the cited registrations,
`
`and yet they have “iconic” related trademarks that are capable of existing without confilsion.
`
`Applicant asserts that it should be afforded the same opportunity to register as the cited registrations.
`
`Therefore, Applicant asserts that this factor also weighs in his favor.
`
`(7) Nature and Extent ofAny Actual Confusion
`
`
`
`The seventh factor concerns the nature and extent of any actual confusion. Id. No evidence exists that
`
`any consumer has been confused by the use of these two marks. Consequently, Applicant asserts that
`
`this factor weighs in his favor or is at least neutral in the likelihood of confilsion analysis.
`
`(8) Length of Time During and Conditions under which There Has Been Concurrent Use Without
`
`Evidence ofActual Confusion
`
`The eighth factor is the length of time during and conditions under which there has been concurrent
`
`use without evidence of actual confusion. Id. Applicant has enjoyed use of its mark since July 7, 2011
`
`without any evidence of actual confusion. Therefore, this factor also weighs in Applicant’s favor.
`
`(9) Variety of Goods on which a Mark Is or Is Not Used
`
`The ninth factor is the variety of goods on which a mark is or is not used (house mark, “family” mark,
`
`product mark). In re E. I du Pont de Nemours & C0., 476 F.2d at 1361, 177 USPQ at 567. None of the
`
`marks are a part of a family of trademark. Consequently, this factor is neutral.
`
`(10) Market Interface Between Applicant and the Owner of a Prior Mark
`
`The tenth factor is the market interface between Applicant and the owner of a valid, prior mark. Id. In
`
`this case, there has been no interface between the Applicant and the Registrant, and therefore this
`
`factor is also neutral.
`
`(11) Extent to which Applicant has a Right to Exclude Others from Use of its Mark on its Goods
`
`The eleventh factor is the extent to which Applicant has a right to exclude others from use of its mark
`
`on its goods. Id. Having enjoyed use of its mark since 2011, Applicant respectfully asserts it has a
`
`
`
`right to exclude others from using a similar trademark in connection with fitness/personal training
`
`clothing and services. This factor weighs in Applicant’s favor.
`
`(12) Extent ofPotential Confusion
`
`The twelfth factor is the extent of potential confusion, ie., whether de minimis or substantial. Ia’.
`
`Because (1) Applicant maintains direct control over the goods and services offered under the
`
`trademark, (2) the services and goods are directed at physical fitness and personal training, and (3)
`
`Applicant has maintained use of the mark since 2011 Without actual confusion, the potential for
`
`confusion is de minimis and Weighs heavily against a likelihood of confusion.
`
`(13) Whether There Are any Other Established Facts Probative ofthe Effect of Use
`
`The thirteenth factor looks to whether there are any other established facts probative of the effect of
`
`use. Applicant reserves all rights to provide a detailed and more descriptive response on this factor if
`
`the USPTO should raise a Section 2(d) refusal in a subsequent Office Action. Applicant further
`
`asserts that the USPTO has found a mark capable of registration, even in cases Where the marks are
`
`nearly identical and are covered under the same classification. Furthermore, courts have long held that
`
`the addition of different terms to a common element appreciably reduces the likelihood of COI1filSi0I1
`
`between two marks. See US Trust v. U.S. States Trust Co., 210 F. Supp. 2d 9, 27-28 (D. Mass 2002)
`
