`Specifically, according to the attached dictionary evidence, the term “gene” is defined as “a unit of heredity composed of DNA occupying a
`fixed position on a chromosome,” and the term “counsel” is defined as “the act of exchanging opinions and ideas; consultation.” (cid:160) See attached
`evidence. Applicant provides “genetic counseling,” in part, and the term “genetic” means “relating to genes, or to the study of genes.”

`Therefore, the mark GENE COUNSEL, as applied to the identified services, merely describes a purpose and subject matter of applicant’s
`services.(cid:160) Accordingly, the proposed mark is merely descriptive, and registration is refused on the Principal Register under Section 2(e)(1) of the
