`SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION
`
`Registration of the applied-for mark is refused because of a likelihood of confusion with the mark in U.S. Registration Nos. 3166812 and
`4309325. Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq. See the enclosed registrations.
`
`Trademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark that it is likely that a potential consumer
`would be confused or mistaken or deceived as to the source of the goods and/or services of the applicant and registrant. See 15 U.S.C. §1052(d).
`The court in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) listed the principal factors to be considered
`when determining whether there is a likelihood of confusion under Section 2(d). See TMEP §1207.01. However, not all of the factors are
`necessarily relevant or of equal weight, and any one factor may be dominant in a given case, depending upon the evidence of record. In re
`Majestic Distilling Co., 315 F.3d 1311, 1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont, 476 F.2d at 1361-62, 177 USPQ at
`567.
`
`In this case, the following factors are the most relevant: similarity of the marks, similarity of the goods and/or services, and similarity of trade
`channels of the goods and/or services. See In re Opus One, Inc., 60 USPQ2d 1812 (TTAB 2001); In re Dakin’s Miniatures Inc. , 59 USPQ2d
`1593 (TTAB 1999); In re Azteca Rest. Enters., Inc., 50 USPQ2d 1209 (TTAB 1999); TMEP §§1207.01 et seq.
`
`The overriding concern is not only to prevent buyer confusion as to the source of the goods and/or services, but to protect the registrant from
`adverse commercial impact due to use of a similar mark by a newcomer. See In re Shell Oil Co., 992 F.2d 1204, 1208, 26 USPQ2d 1687, 1690
`(Fed. Cir. 1993). Therefore, any doubt regarding a likelihood of confusion determination is resolved in favor of the registrant. TMEP
`§1207.01(d)(i); see Hewlett-Packard Co. v. Packard Press, Inc., 281 F.3d 1261, 1265, 62 USPQ2d 1001, 1003 (Fed. Cir. 2002); In re Hyper
`Shoppes (Ohio), Inc., 837 F.2d 463, 464-65, 6 USPQ2d 1025, 1025 (Fed. Cir. 1988).
`
`Applicant’s mark and the Registered Marks are Similar
`
`In a likelihood of confusion determination, the marks are compared for similarities in their appearance, sound, meaning or connotation and
`commercial impression. In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973); TMEP §1207.01(b).
`Similarity in any one of these elements may be sufficient to find a likelihood of confusion. In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB
`1988); In re Lamson Oil Co., 6 USPQ2d 1041, 1043 (TTAB 1987); see TMEP §1207.01(b).
`
`Applicant's mark is “COOLHORSE.” The registered marks are “COOL HORSE,” 3166812 and “KOOL HORSE,”4309325, respectively. The
`marks are essentially phonetic equivalents and thus sound similar. Similarity in sound alone may be sufficient to support a finding that the
`marks are confusingly similar. In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB 1988); see In re 1st USA Realty Prof’ls, Inc., 84 USPQ2d

`1581, 1586 (TTAB 2007); TMEP §1207.01(b)(iv).
`
`The marks create the identical commercial impression. The different spelling of COOLHORSE or deletion of the space between COOL and
`HORSE does not change the commercial impression of the applicant’s mark versus the registered marks in any way.
`
`For these reasons, the marks are similar for the purposes of a likelihood of confusion analysis.
`
`The Goods/Services are Highly Related
`
`The goods and/or services of the parties need not be identical or directly competitive to find a likelihood of confusion. See Safety-Kleen Corp. v.
`Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480 (C.C.P.A. 1975); TMEP §1207.01(a)(i). Rather, they need only be related in
`some manner, or the conditions surrounding their marketing are such that they would be encountered by the same purchasers under
`circumstances that would give rise to the mistaken belief that the goods and/or services come from a common source. In re Total Quality Group,
`Inc., 51 USPQ2d 1474, 1476 (TTAB 1999); TMEP §1207.01(a)(i); see, e.g., On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080, 1086-87,
`56 USPQ2d 1471, 1475-76 (Fed. Cir. 2000); In re Martin’s Famous Pastry Shoppe, Inc. , 748 F.2d 1565, 1566-68, 223 USPQ 1289, 1290 (Fed.
`Cir. 1984).
`
`Applicant’s class 031 goods are identified as “Horse feed.”
`
`The class 031 goods for Registration No. 3166812 are identified as “Thirst quenching beverage for horses of both flavored and unflavored
`varieties.”
`
`Applicant’s goods are related to registrant’s goods because have the very limited use as being
`
` used to nourish a horse, and no other animals.
`
`Applicant’s class 018 goods are identified as “Horse tack, namely, saddles and supplies.”
`
`The class 018 goods for Registration No. 4309325 are identified as “blankets for animals; horse blankets; saddle blankets; and saddlebags.”
`
`Applicant’s identification of goods includes the goods listed in registrant’s identification because applicant has broadly identified its goods as
`“supplies” and the registrants’ saddle blankets and saddle bags have a complementary use to applicant’s saddles.
` As a result, the
`goods/services are related because they overlap.
`
`The applicant’s class 035 services are related the registrant’s horse blankets and saddlebags because the attached third-party registrations show
`that third parties also commonly sell these goods in class 018 and operate retail stores featuring these goods in class 035.
`
`Because the marks are similar and the goods and services overlap, confusion as to source is likely.
`
`Generally, the greater degree of similarity between the applied-for mark and the registered mark, the lesser the degree of similarity between the
`goods and/or services of the respective parties that is required to support a finding of likelihood of confusion. In re Davey Prods. Pty Ltd., 92
`USPQ2d 1198, 1202 (TTAB 2009); In re Thor Tech, Inc., 90 USPQ2d 1634, 1636 (TTAB 2009). The marks in this case are nearly identical, are
`phonetic equivalents and have the same commercial impression
`
`Thus, registration is refused under Trademark Act Section 2 (d) based on a likelihood of confusion.
`
`Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) by submitting evidence and arguments in
`support of registration.
`
`Applicant must respond to the requirement(s) set forth below.
`
`Identification of Goods –Indefinite Wording
`
`The following wording in bold in the identification of goods is indefinite and must be clarified. See TMEP §1402.01.
`International Class 018: “Horse tack, namely, saddles and supplies” Applicant must specify the types of supplies, e.g., saddle belts, girth straps,
`etc..
`
`In the identification of goods, applicant must use the common commercial or generic names for the goods, be as complete and specific as
`possible, and avoid the use of indefinite words and phrases.
`If applicant uses indefinite words such as “accessories,” “components,”
`“devices,” “equipment,” “materials,” “parts,” “systems” or “products,” such words must be followed by “namely,” followed by a list of

`Specimen Not Legible for Class 031
`
`Registration is refused because the specimen is altered, mutilated, or illegible, and thus does not clearly show the applied-for mark in use in
`commerce. 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a). An application based on Trademark Act
`Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of goods and/or services
`
`identified in the application or amendment to allege use. 15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
`
`Examples of specimens for goods may include tags, labels, instruction manuals, containers, and photographs that show the mark on the actual
`goods or packaging, or displays associated with the actual goods at their point of sale. See TMEP §§904.03 et seq. Webpages may also be
`specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods.
`TMEP §904.03(i). Examples of specimens for services may include advertising and marketing materials, brochures, photographs of business
`signage and billboards, and website printouts that show the mark used in the actual sale, rendering, or advertising of the services. See TMEP
`§§1301.04 et seq.
`
`Applicant may respond to this refusal by satisfying one of the following:
`
`(1) Submit a true, unaltered copy of the originally submitted specimen that is clear and readable, with a statement by the person who
`
`transmitted it that it is a true copy of the specimen that was originally submitted.
`
`(2) Submit a different specimen (a verified “substitute” specimen) that was in actual use in commerce at least as early as the filing date
`
`of the application or prior to the filing of an amendment to allege use.
`
`(3) Amend the filing basis to intent to use under Section 1(b), for which no specimen is required. This option will later necessitate
`additional fee(s) and filing requirements such as providing a specimen at a subsequent date.
`

`Partial Abandonment and Applicant’s Response
`
`For this application to proceed toward registration, applicant must explicitly address each refusal and/or requirement raised in this Office action.
`If the action includes a refusal, applicant may provide arguments and/or evidence as to why the refusal should be withdrawn and the mark should
`register. Applicant may also have other options for responding to a refusal and should consider such options carefully. To respond to
`requirements and certain refusal response options, applicant should set forth in writing the required changes or statements.
