`TMEP §1211. The primary significance of the mark to the purchasing public determines whether a term is primarily merely a surname. In re Kahan
`& Weisz Jewelry Mfg. Corp., 508 F.2d 831, 832, 184 USPQ 421, 422 (C.C.P.A. 1975); In re Binion, 93 USPQ2d 1531, 1537 (TTAB 2009); see
`TMEP §§1211, 1211.01.

`ombining a surname with the generic name for the goods and/or services does not overcome a mark’s surname significance. See Mitchell
`Miller, P.C. v. Miller, 105 USPQ2d 1615, 1622 (TTAB 2013) (holding MILLER LAW GROUP primarily merely a surname for legal services,
`noting that LAW GROUP is a generic designation for a law firm); In re Hamilton Pharms. Ltd., 27 USPQ2d 1939, 1944 (TTAB 1993) (holding
`HAMILTON PHARMACEUTICALS primarily merely a surname for pharmaceutical products); In re Cazes, 21 USPQ2d 1796, 1797 (TTAB
`1991) (holding BRASSERIE LIPP primarily merely a surname for restaurant services); TMEP §1211.01(b)(vi).
`Please see the attached evidence from LexisNexis, establishing the surname significance of the surname GLAUBER. This evidence shows the
`applied-for mark appearing 409 times as a surname in a nationwide telephone directory of names. The addition of the wording QUALITY
`CLOTHING does not overcome the mark’s surname significance.
`A mark deemed primarily merely a surname may be registered on the Principal Register under Trademark Act Section 2(f) by satisfying one of
`the following:
`(1) Submit the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20: “The mark has become
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`distinctive of the goods and/or services through applicant’s substantially exclusive and continuous use in commerce for at
`least the five years immediately before the date of this statement.” 37 C.F.R. §2.41(b); TMEP §1212.05(d); see 37 C.F.R.
`§2.193(e)(1).; or
`(2) Submit actual evidence of acquired distinctiveness. 37 C.F.R. §2.41(a); TMEP §1212.06. Such evidence may include the following:
`examples of advertising and promotional materials that specifically promote the applied-for mark as a trademark and/or service mark
`in the United States; dollar figures for advertising devoted to such promotion; dealer and consumer statements of recognition of the
`applied-for mark as a trademark and/or service mark; and any other evidence that establishes recognition of the applied-for mark as a
`source-identifier for the goods and/or services. See In re Ideal Indus., Inc., 508 F.2d 1336, 184 USPQ 487 (C.C.P.A. 1975); In re
`Instant Transactions Corp. of Am., 201 USPQ 957 (TTAB 1979); TMEP §§1212.06 et seq.
`Trademark Act Section 2(f), 15 U.S.C. §1052(f); see 37 C.F.R. §2.41; TMEP §§1211, 1212.
`If applicant cannot satisfy one of the above, applicant can amend the application to seek
`registration on the Supplemental Register. Trademark Act Section 23, 15 U.S.C. §1091; see 37
`C.F.R. §§2.47, 2.75(a).
`If applicant chooses to respond to the refusal to register, then applicant must also respond to the following issue.
`Disclaimer
`Applicant must disclaim the wording “QUALITY CLOTHING” because it merely describes an ingredient, quality, characteristic, function,
`feature, purpose, or use of applicant’s goods and/or services, and thus is an unregistrable component of the mark. See 15 U.S.C. §§1052(e)(1),
`1056(a); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re
`Oppedahl & Larson LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); TMEP §§1213, 1213.03(a).
`“ Marks that are merely laudatory and descriptive of the alleged merit of a product [or service] are . . . regarded as being descriptive” because
`“[s]elf-laudatory or puffing marks are regarded as a condensed form of describing the character or quality of the goods [or services].” (cid:160)
`DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1256, 103 USPQ2d 1753, 1759 (Fed. Cir. 2012) (quoting In re The
`Boston Beer Co., 198 F.3d 1370, 1373, 53 USPQ2d 1056, 1058 (Fed. Cir. 1999)); see In re Nett Designs, Inc., 236 F.3d 1339, 1342, 57 USPQ2d
`1564, 1566 (Fed. Cir. 2001) (holding THE ULTIMATE BIKE RACK merely laudatory and descriptive of applicant’s bicycle racks being of
`superior quality); In re The Boston Beer Co., 198 F.3d at 1373-74, 53 USPQ2d at 1058-59 (holding THE BEST BEER IN AMERICA merely
`laudatory and descriptive of applicant’s beer and ale being of superior quality); TMEP §1209.03(k). (cid:160) In fact, “puffing, if anything, is more
`likely to render a mark merely descriptive, not less so.” (cid:160) DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d at 1256, 103 USPQ2d
`at 1759.
`The attached dictionary definition shows that this wording names the genus of applicant’s goods and is otherwise merely laudatory and
`descriptive thereof. (cid:160) Merely descriptive and generic terms lack trademark significance and must be disclaimed.
`An applicant may not claim exclusive rights to terms that others may need to use to describe their goods and/or services in the marketplace. See
`Dena Corp. v. Belvedere Int’l, Inc. , 950 F.2d 1555, 1560, 21 USPQ2d 1047, 1051 (Fed. Cir. 1991); In re Aug. Storck KG, 218 USPQ 823, 825
`(TTAB 1983). A disclaimer of unregistrable matter does not affect the appearance of the mark; that is, a disclaimer does not physically remove
`the disclaimed matter from the mark. See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 978, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP
`§1213.
`If applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark. See In re Stereotaxis Inc., 429 F.3d
`1039, 1040-41, 77 USPQ2d 1087, 1088-89 (Fed. Cir. 2005); TMEP §1213.01(b).
