`PRIMARILY GEOGRAPHICALLY DESCRIPTIVE REFUSAL UNDER SECTION
`
`2(E)(2)
`
`In the Office Action, the Examining Attorney refused registration of the applied-for
`
`mark on the basis that it is potentially primarily geographically descriptive of the origin of the
`
`applicant’s goods and services identified in the application. The Examining Attorney referred
`
`to excerpted online dictionary meanings which appeared the term CHINESE to support his
`
`refilsal to register Applicant’s mark. Applicant respectfillly requests that the Examining
`
`Attorney withdraw the refusal to register for the reasons set forth below.
`
`A mark can be considered primarily geographically descriptive under Section 2 (e) (2)
`
`of the Trademark Act only when the following is demonstrated:
`
`(1) The primary significance of the mark is a generally known geographic place or
`
`location;
`
`(2) The goods and/or services for which applicant seeks registration originate in the
`
`geographic place identified in the mark; and
`
`(3) Purchasers would be likely to make a goods—place or services-place association;
`
`that is, purchasers would be likely to believe that the goods and/or services
`
`originate in the geographic place identified in the mark.
`
`TMEP §12l0.0l(a); see In re Societe Generale des Eaux Mlfnerales de Vittel S.A., 824 F.2d
`
`957, 959, 3 USPQ2d 1450 (Fed. Cir. 1987); In re Hollywood Lawyers Online, 110 USPQ2d
`
`1852, 1853 (TTAB 2014).
`
`When analyzed in detail, it becomes clear that Applicant’s mark does not satisfy at
`
`least one of the above three prerequisites due to the following reasons:
`
`1. The First Two Characters of the Mark Means “Chinese Person,” NOT “China”
`
`The Office mistakenly believed the first two characters of the applied-for mark means
`
`“of or relating to China.” The Applicant respectfully disagrees. The first two characters of

`the applied-for mark is pronounced “hua-ren,” which literally means “Chinese Person,” or
`
`“ethnic Chinese,” see online Chinese—E11glish dictionary:
`
`(http 2//www .mdbg.net/chindict/c hindict.php?wdrst= l &popup= 1 &wdqchid=%E8°/o8F%AF%
`
`E4”/goBA%BA), a copy of which is attached. These two characters have a primary meaning
`
`that is not geographic.
`
`2. There Can Be No Services/Place Association
`
`The record failed to establish that purchasers would make a services/place association
`
`between CHINA and medical/OBGYN services.
`
`The Examining Attorney maintained that the primary significance of the first two
`
`Chinese character is a generally-known geographic place, that Applicant is located there, and
`
`that purchasers would believe that her services originates from CHINA.
`
`While there is no dispu.te that applicant°s has an address in Taiwan, and that Taiwan
`
`and/or China is known to the American consu.mers who may require medical or OBGYN
`
`services, Taiwan and/or China does not have any significance in medical services and
`
`OBGYN services. Therefore, a services/place association cannot be presumed from the fact
`
`that the mark has the word “CHINESE.” The Examining Attomey failed to present sufficient
`
`evidence to establish that American consumers in need of medical and OBGYN services
`
`would in fact make such an association.
`
`Moreover, Taiwan and China are sufficiently remote and distant from the United
`
`States with respect to American consumers in need of immediate medical/OBGYN help, that
`
`such services/place association would not be made. In other words, American consumers
`
`seeking medical/OBGYN services would not assume such services are provided thousands of
`
`miles away from across the Pacific Ocean. The American consumers would reasonably
`
`associate the word “CHINESE” in the applied—for mark as relating to services where the
`
`service—provider is capable of speaking the Chinese language. Also, the American consumers
`
`would reasonably associate the two characters “hua ren” in the applied—for mark as relating to
`
`services where the target consumers are those of Chinese decent.

`3. The Goods Do Not Originate from the Geographic Location
`
`The goods and services ofCHlNESE EGG BANK do not originated from China.
`
`Although the Applicant has an address in Taiwan, it should be noted that Taiwan is not part of
`
`China. Taiwan and China are two distinct political entities. Purchasers would not believe that
`
`the goods and services originate from China. The official name of Taiwan, as provided by the
`
`following page of U.S. Department of States, is Taiwan.
`

`
`4. By Definition The Applied-For Services Are NOT to be Provided Outside of the
`
`United States
`
`Further, the applied for goods and services are hospitals, midwife services, OBGYN
`
`services, etc., all of which are medically-related services which the client has intent to render
`
`in commerce. And by definition, to satisfy the “use in commerce” requirement, these services
`
`must be rendered in commerce that may be regulated by the United States Congress.
`
`In other
`
`words, these medically-related services would be rendered in more than one State or in the
`
`United State and a foreign country. Therefore, by definition purchasers would not believe
`
`these medically—related services are provided out of the United States, let alone China. And as
`
`a result, there cannot be a services/place association.
`
`CONCLUSION
`
`Therefore, as discussed above, the applied for mark is not primarily geographically
`
`descriptive. Applicant respectfully submits that its application is now in condition for
`
`publication. The Examining Attorney is invited to contact the undersigned with any questions

`A conference call was held on July 8, 2015, with Lynn J. Alstadt and Ralph
`
`G. Fischer, counsel for Petitioner, and Anthony King, counsel for Patent Owner.
`
`The purpose of the call was to determine whether the Corrected Petition (Paper 5,
`
`“Pet.”) complied with the format requirements for documents submitted in an inter
`
`parres review. The applicable rule (37 C.F.R. § 42.6(a)(2)) states that either a
`
`proportional or monospaced font may be used. The proportional font must be 14-
`
`point or larger, and the monospaced font must not contain more than four
`
`characters per centimeter (ten characters per inch). Double spacing must be used.
`
`Zipshade Industrial (B.V.I.) Corp. (“Patent Owner”) filed a Preliminary
`
`Response (Paper 9, “Prelim. Resp”) in which Patent Owner asserted that
`
`“Petitioner submitted a 57-page Petition with a spacing of 1.5, and 12-point font.”
`
`Prelim. Resp. 6. Patent Owner also asserted that if the Petition was “formatted as
`
`double-spaced with 14-point font, it would expand to 80 pages.” Id. Our rules
`
`limit a Petition in an inter partes review to 60 pages. 37 C.F.R. § 42.24(a)(1)(i).
`
`Our analysis of the Petition indicated that the Petition was filed with a 12-
`
`point Times New Roman font with double spacing. We initiated a conference call
`
`with the parties to determine the format in which the Petition was filed.
`
`Petitioner acknowledged that the Corrected Petition was submitted in error
`
`with a 12-point Times New Roman font with double spacing. Petitioner also stated
`
`that when the Corrected Petition was reformatted to a 14-point proportional font
`
`with double spacing, the Corrected Petition was 65 pages. Petitioner stated that
`
`when some of the discussion in the Corrected Petition about the prosecution
`
`history was eliminated, and when the claim charts were revised to eliminate excess
`
`spacing, the Petition was 60 pages.
`
`We determined that the Petitioner shall file a second corrected Petition in
`
`14-point proportional font with double spacing that does not exceed 60 pages and
`
`

`otherwise complies fully with our rules. In accordance with Petitioner’s
`
`representations, the second corrected Petition will eliminate some discussion of the
`
`prosecution history, eliminate excess spacing in the claim chartsl and shall not add

`any new arguments, evidence, or information. The Petitioner also shall file a red-
`
`lined version of the second corrected Petition indicating all changes and additions
`
`to the Corrected Petition. The second corrected Petition and red-lined version shall
`
`be filed no later than Friday, July 10, 2015.
