`
`SUSPENSION NOTICE: NO RESPONSE NEEDED
`
`(cid:160) I
`
`SSUE/MAILING DATE: 5/2/2016
`
`The trademark examining attorney is suspending action on the application for the reason(s) stated below.(cid:160) See 37 C.F.R. §2.67; TMEP §§716 et
`
`seq.(cid:160)(cid:160)
`
`The effective filing date of the pending application(s) identified below precedes the filing date of applicant’s application. (cid:160) If the mark in the
`referenced application(s) registers, applicant’s mark may be refused registration under Section 2(d) because of a likelihood of confusion with
`that registered mark(s). (cid:160) See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP §§1208 et seq.(cid:160) Therefore, action on this application is suspended until
`the earlier-filed referenced application(s) is either registered or abandoned.(cid:160) 37 C.F.R. §2.83(c).(cid:160) A copy of information relevant to this referenced
`application(s) was sent previously.
`
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`(cid:160) T
`
`- Application Serial No(s). 86509612
`
`he potential refusal is limited to goods in Class 25.
`
`(cid:160)
`(cid:160)
`(cid:160)
`(cid:160)(cid:160)
`

`

`(cid:160) T
`
`he USPTO will periodically conduct a status check of the application to determine whether suspension remains appropriate, and the trademark
`examining attorney will issue as needed an inquiry letter to applicant regarding the status of the matter on which suspension is based.(cid:160) TMEP
`§§716.04, 716.05.(cid:160) Applicant will be notified when suspension is no longer appropriate.(cid:160) See TMEP §716.04.
`
`(cid:160) N
`
`o response to this notice is necessary; however, if applicant wants to respond, applicant should use the “Response to Suspension Inquiry or
`Letter of Suspension” form online at http://teasroa.uspto.gov/rsi/rsi.
`
`(cid:160) W
`
`ith respect to applicant’s preliminary response dated March 17, 2016, the examining attorney has considered applicant’s arguments carefully
`and finds them unpersuasive.(cid:160) Applicant argues primarily that consumer confusion is unlikely due to differences in appearance, pronunciation
`and connotation between the words BOMBER and BOMBSHELL.(cid:160) Such arguments fails to fully consider the overall similarities of the marks
`when considered in their entireties.(cid:160) Each of the marks combines a “BOMB-” formative term with “BEHAVIOR” in the same order.
`(cid:160) These
`similarities are sufficient to diminish the differences between the marks, particularly given the identical nature of the goods.(cid:160) Where the goods
`and/or services of an applicant and registrant are identical or virtually identical, the degree of similarity between the marks required to support a
`finding of likelihood of confusion is not as great as in the case of diverse goods and/or services.(cid:160) See In re Bay State Brewing Co., 117 USPQ2d
`1958, 1960 (TTAB 2016) (citing Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1368, 101 USPQ2d 1713, 1721 (Fed. Cir. 2012));
`United Global Media Grp., Inc. v. Tseng, 112 USPQ2d 1039, 1049 (TTAB 2014) (quoting Century 21 Real Estate Corp. v. Century Life of Am.,
`970 F.2d 874, 877, 23 USPQ2d 1698, 1701 (Fed. Cir. 1992)); TMEP §1207.01(b).
