`
`Registration 4440478 is cited only as to the following items in applicant’s identification of goods:(cid:160) books, journals, prints, art pictures,
`photographs, artwork, and accessories.
`
`(cid:160)I
`
`n any likelihood of confusion determination, two key considerations are similarity of the marks and similarity or relatedness of the goods and/or
`services.(cid:160) In re Aquamar, Inc., 115 USPQ2d 1122, 1126 (TTAB 2015) (citing Federated Foods, Inc. v. Fort Howard Paper Co., 544 F.2d 1098,
`1103, 192 USPQ 24, 29 (C.C.P.A. 1976)); In re Iolo Techs., LLC, 95 USPQ2d 1498, 1499 (TTAB 2010); see TMEP §1207.01.(cid:160) That is, the
`marks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression.(cid:160) In re Viterra Inc., 671 F.3d
`1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012) (quoting In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567
`(C.C.P.A. 1973)); TMEP §1207.01(b)-(b)(v).(cid:160) Additionally, the goods and/or services are compared to determine whether they are similar or
`commercially related or travel in the same trade channels.(cid:160) See Coach Servs., Inc. v. Triumph Learning LLC, 668 F.3d 1356, 1369-71, 101

`
`Comparing the Marks
`
`(cid:160)M
`
`arks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression.(cid:160) Stone Lion Capital
`Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1321, 110 USPQ2d 1157, 1160 (Fed. Cir. 2014) (quoting Palm Bay Imps., Inc. v. Veuve
`Clicquot Ponsardin Maison Fondee En 1772, 396 F. 3d 1369, 1371, 73 USPQ2d 1689, 1691 (Fed. Cir. 2005)); TMEP §1207.01(b)-(b)(v).(cid:160)
`“Similarity in any one of these elements may be sufficient to find the marks confusingly similar.” (cid:160) In re Davia, 110 USPQ2d 1810, 1812 (TTAB
`2014) (citing In re 1st USA Realty Prof’ls, Inc. , 84 USPQ2d 1581, 1586 (TTAB 2007)); In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB
`1988)); TMEP §1207.01(b).
`
`(cid:160)A
`
`lthough marks are compared in their entireties, one feature of a mark may be more significant or dominant in creating a commercial
`impression.(cid:160) See In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012); In re Nat’l Data Corp. , 753 F.2d 1056,
`1058, 224 USPQ 749, 751 (Fed. Cir. 1985); TMEP §1207.01(b)(viii), (c)(ii).(cid:160) Greater weight is often given to this dominant feature when
`determining whether marks are confusingly similar.(cid:160) See In re Nat’l Data Corp. , 753 F.2d at 1058, 224 USPQ at 751.
`
`(cid:160)C
`
`onsumers are generally more inclined to focus on the first word, prefix, or syllable in any trademark or service mark.(cid:160) See Palm Bay Imps., Inc.
`v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F. 3d 1369, 1372, 73 USPQ2d 1689, 1692 (Fed. Cir. 2005); Presto Prods., Inc. v.
`Nice-Pak Prods., Inc., 9 USPQ2d 1895, 1897 (TTAB 1988) (“it is often the first part of a mark which is most likely to be impressed upon the
`mind of a purchaser and remembered” when making purchasing decisions).
`
`(cid:160)H
`
`ere, applicant’s mark is “KEMO SABE GRIT” in standard characters.
`·(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160) 4318447 is “KEMOSABE” in standard characters;
`·(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160) 4634298 is “KEMOSABE LITE” in standard characters with a disclaimer of “LITE”;
`·(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160) 4874649 is “KEMOSABE” in standard characters;
`·(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160) 4621550 is “KEMOSABE” in standard characters;
`
`(cid:160) The cited registrations are:
`
`(cid:160)
`(cid:160)(cid:160)
`(cid:160)(cid:160)
`
`
`·(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160) 4556144 is “KEMOSABE” in standard characters; and
`
`·(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160) 4440478 is “KEMOSABE” in standard characters. (cid:160)(cid:160)
`
`All the cited registrations contain the arbitrary term “KEMOSABE”; which is phonetically identical, and identical in sound and meaning, to
`applicant’s “KEMO SABE”.
`(cid:160) That applicant has added the term “GRIT” does not obviate the clear similarities, as the marks share the
`distinctive term “KEMOSABE” as the first (or only) portion of the marks. (cid:160) Thus, it appears that applicant’s “KEMO SABE GRIT” marks
`indicate a “GRIT” line in the “KEMOSABE” family of goods/services, with the goods and services emanating from a single (or related)
`
`source.(cid:160) As such, an examination of the marks as a whole shows that the overall impression of the marks is that of highly similar marks.(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Comparing the Goods and/or Services
`
`(cid:160)T
`
`he goods and/or services of the parties need not be identical or even competitive to find a likelihood of confusion.(cid:160) See On-line Careline Inc. v.
`Am. Online Inc., 229 F.3d 1080, 1086, 56 USPQ2d 1471, 1475 (Fed. Cir. 2000); Recot, Inc. v. Becton, 214 F.3d 1322, 1329, 54 USPQ2d 1894,
`1898 (Fed. Cir. 2000) (“[E]ven if the goods in question are different from, and thus not related to, one another in kind, the same goods can be
`
`related in the mind of the consuming public as to the origin of the goods.”); TMEP §1207.01(a)(i). (cid:160)(cid:160)
`
`The respective goods and/or services need only be “related in some manner and/or if the circumstances surrounding their marketing [be] such
`that they could give rise to the mistaken belief that [the goods or services] emanate from the same source.” (cid:160) Coach Servs., Inc. v. Triumph
`Learning LLC, 668 F.3d 1356, 1369, 101 USPQ2d 1713, 1722 (Fed. Cir. 2012) (quoting 7-Eleven Inc. v. Wechsler, 83 USPQ2d 1715, 1724
`(TTAB 2007)); TMEP §1207.01(a)(i).
`
`(cid:160)C
`
`onsumers are likely to be confused by the use of similar marks on or in connection with goods and with services featuring or related to those
`goods.(cid:160) TMEP §1207.01(a)(ii); see In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988) (holding BIGG’S for retail
`grocery and general merchandise store services likely to be confused with BIGGS for furniture); In re United Serv. Distribs., Inc., 229 USPQ 237
`(TTAB 1986) (holding design for distributorship services in the field of health and beauty aids likely to be confused with design for skin cream);
`In re Phillips-Van Heusen Corp., 228 USPQ 949 (TTAB 1986) (holding 21 CLUB for various items of men’s, boys’, girls’ and women’s
`clothing likely to be confused with THE “21” CLUB (stylized) for restaurant services and towels); In re U.S. Shoe Corp., 229 USPQ 707 (TTAB
`1985) (holding CAREER IMAGE (stylized) for retail women’s clothing store services and clothing likely to be confused with CREST CAREER
`IMAGES (stylized) for uniforms); Steelcase Inc. v. Steelcare Inc., 219 USPQ 433 (TTAB 1983) (holding STEELCARE INC. for refinishing of
`furniture, office furniture, and machinery likely to be confused with STEELCASE for office furniture and accessories); Mack Trucks, Inc. v.
`Huskie Freightways, Inc., 177 USPQ 32 (TTAB 1972) (holding similar marks for trucking services and on motor trucks and buses likely to cause
`confusion).

`
`Registrations 4318447 and 4634298
`
`he registrations in RNs 4318447 and 4634298 are owned by one owner.(cid:160) The(cid:160) registrations are for the following items:
`
`Artificial coffee; Artificial coffee and tea; Beverages made of coffee; Beverages with a coffee base; Caffeine-free coffee;
`Chicory and chicory mixtures, all for use as substitutes for coffee; Coffee; Coffee; Coffee and artificial coffee; Coffee and
`coffee substitutes; Coffee and tea; Coffee based beverages; Coffee beverages with milk; Coffee essences; Coffee essences for
`use as substitutes for coffee; Coffee extracts; Coffee extracts for use as substitutes for coffee; Coffee flavored syrup used in
`making food beverages; Coffee pods; Coffee substitutes; Coffee substitutes; Coffee-based beverage containing milk; Coffee-
`based beverages; Iced coffee; Instant coffee; Prepared coffee and coffee-based beverages; Unroasted coffee (RN 4318447).
`
`Artificial coffee; Artificial coffee and tea; Beverages made of coffee; Beverages with a coffee base; Caffeine-free coffee;
`Chicory and chicory mixtures, all for use as substitutes for coffee; Coffee; Coffee; Coffee and artificial coffee; Coffee and
`coffee substitutes; Coffee and tea; Coffee based beverages; Coffee beverages with milk; Coffee capsules containing coffee for
`brewing; Coffee essences; Coffee essences for use as substitutes for coffee; Coffee extracts; Coffee extracts for use as
`substitutes for coffee; Coffee flavored syrup used in making food beverages; Coffee pods; Coffee substitutes; Coffee
`substitutes; Coffee-based beverage containing milk; Coffee-based beverages; Coffee-based beverages containing ice cream
`(affogato); Coffee-based iced beverages; Iced coffee; Instant coffee; Mixtures of coffee and chicory; Prepared coffee and
`coffee-based beverages; Unroasted coffee (RN 4634298).
`
`Applicant’s barware, kitchenware, and mugs are all goods that would be likely to be used with coffee and coffee-based beverages such as those
`listed in the cited registrations.(cid:160) Where the goods at issue have complementary uses, and thus are often used together or otherwise purchased by
`the same purchasers for the same or related purposes, such goods have generally been found to be sufficiently related such that confusion would
`be likely if they are marketed under the same or similar marks.(cid:160) See In re Martin’s Famous Pastry Shoppe, Inc. , 748 F.2d 1565, 1567, 223 USPQ
`1289, 1290 (Fed. Cir. 1984) (holding bread and cheese to be related because they are often used in combination and noting that “[s]uch
`complementary use has long been recognized as a relevant consideration in determining a likelihood of confusion”); In re Toshiba Med. Sys.
`Corp., 91 USPQ2d 1266, 1272 (TTAB 2009) (holding medical MRI diagnostic apparatus and medical ultrasound devices to be related, based in
`
`(cid:160)
`(cid:160)(cid:160)
`(cid:160)
`
`
`part on the fact that such goods have complementary purposes because they may be used by the same medical personnel on the same patients to
`treat the same disease).
`
`(cid:160)H
`
`ere, attached evidence shows that consumers are likely to expect that a provider of coffee would also provide coffee makers, coffee mugs, and
`other “accessories” for making and enjoying coffee-based items. (cid:160) As such, the listed goods in the applicant’s identification are highly related to
`
`the registrant’s listed goods. (cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Registrations 4874649, 4556144, and 4621550
`
`(cid:160)A
`
`pplicant’s listed “artwork” is vague and overly broad, as discussed further in the identification / classification requirement, below.
`
`(cid:160) Attached
`
`definitional evidence shows that an artwork is any work of art, including music, literature, sculpture, etc.(cid:160)(cid:160)
`
`The cited registrations list entertainment services in the nature of audio and video production services (RN 4874649), sound recordings (RN
`4556144), and streaming of audio and video works over the internet (RN 4621550).(cid:160) As such, the cited registrations are all related to various
`types of works of art and the enabling of consumers to have access to such works of art.(cid:160) Accordingly, applicant’s listed “artwork” is highly
`related to the goods and services listed by the registrants.
`
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Registration 4440478
`
`(cid:160)H
`
`ere, the registrant lists “Posters; stickers; bumperstickers; decals; calendars; postcards; notebooks; memo pads; stationery; greeting cards; note
`pads.” (cid:160) Applicant lists “books” without limitation, which would include the noteb ooks listed by the registrant.(cid:160) Journals are similar to
`notebooks, and attached evidence shows that many journals are notebooks.(cid:160) The prints, art pictures, photographs and postcards are similar, as
`postcards often include art pictures, prints, and photographs, as shown by attached evidence.(cid:160) The goods of the parties include printed matter,
`
`and as such, they are related.(cid:160)(cid:160)
`
`Finally, attached definitional evidence shows that an accessory is a small supplementary part or helpful tool.(cid:160) Without any limitation on the type
`of accessory, it is unclear whether the applicant’s accessories are pencils to use with the journals, or coffee stir sticks to use with the mugs. (cid:160) As
`
`Conclusion
`
`such, the accessories wording could include any goods, and therefore is a term that is highly related to the goods listed by the registrant.(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`n sum, for the reasons outlined above, applicant’s mark is refused registration based on a likelihood of confusion with the cited mark. (cid:160)(cid:160)
`
`(cid:160)I
`
`Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) by submitting evidence and arguments in
`support of registration.
`
`(cid:160)I
`
`f applicant responds to the refusal(s), applicant must also respond to the requirement(s) set forth below.
`
`Requirement – Identification and Classification
`
`All identifications must be precise and identify the goods with particularity using common or commercial names for the goods.(cid:160) TMEP
`§1402.01.(cid:160)
`
`Applicant’s current identification reads (applicant should note that the wording requiring amendment, as discussed further below, has been
`highlighted in bold font):
`
`International Class 025:(cid:160) Clothing, caps, baseball caps, belts, boots, chaps, gloves, hats, hat bands; buckles; blankets; barware,
`kitchenware, canteens, flasks, mugs; stuffed animals, furniture; bags, horse tack, leather cases, purses, wallets, backpacks;
`money clips, books, journals, prints, art pictures, photographs; jewelry, cuff links; knives, branding irons; spurs;
`accessories; artwork; home furnishings.
`
`The identification is unacceptable as presently worded because certain goods are worded indefinitely, need clarification and/or have been
`misclassified. In the identification, applicant must use the common commercial or generic names for the goods, be all-inclusive, as complete and
`specific as possible, and avoid the use of indefinite words and phrases.(cid:160) If applicant chooses to use indefinite terms, then such terms must be
`followed by the word "namely" and a list of the specific goods identified by their common commercial or generic names.(cid:160) TMEP §§1402.01 and
`1402.03(a).
`
`(cid:160)S
`
`pecifically, in addition to the issues identified below, the word “clothing” in the identification of goods in International Class 025 is indefinite
`and must be clarified because it does not specify the types of “clothing” with which the mark will be used. (cid:160) See TMEP §§1402.01, 1402.03,
`
`(cid:160)(cid:160)(cid:160)

`(cid:160)
`
`
`1904.02(c), (c)(ii).(cid:160)(cid:160)
`
`The international classification of goods in applications filed under Trademark Act Section 66(a) cannot be changed from the classification the
`International Bureau assigned to the goods in the corresponding international registration.(cid:160) 37 C.F.R. §2.85(d); TMEP §1401.03(d).(cid:160)
`Therefore, although clothing can be classified in international classes other than International Class 025 (e.g., International Classes 009, 010, and
`018), any modification to the identification must identify goods in International Class 025 only, the class specified in the application for such
`goods.(cid:160) See TMEP §1904.02(c)(ii).
`
`(cid:160)E
`
`xamples of acceptable identifications for clothing in International Class 025 include the following:(cid:160) “shirts,” “shorts,” “pants,” “coats,”
`“dresses,” skirts,” and “socks.” (cid:160) Applicant may also amend the identification by inserting the word “namely,” after “clothing” and then listing
`
`the specific types of clothing items.(cid:160)(cid:160)
`
`“Buckles” is overly broad and indefinite as the type or purpose of the buckle determines the classification. (cid:160) For instance, buckles for
`watchstraps are in International Class 014, belt buckles are in International Class 026, and buckles that are hardware of common metal are in
`
`International Class 006.(cid:160) Therefore, applicant must clarify the type of buckle and classify the goods accurately or delete the goods.(cid:160)(cid:160)
`
`Similarly, “blankets” are classified according to the type of blanket. (cid:160) For instance, fire blankets are in International Class 009, medical blankets
`are in International Class 010, horse blankets are in International Class 018, concrete curing blankets are in International Class 022, bed blankets
`
`are in International Class 024, yoga blankets are in International Class 028.(cid:160)(cid:160)
`
`(cid:160) Applicant must clarify the particular goods and classify them
`“Barware” and “kitchenware” could include many items in multiple classes.
`correctly.(cid:160) “Stuffed animals” is indefinite as it could refer to taxidermied animals in International Class 020 or stuffed toy animals in
`
`International Class 028.(cid:160) Regardless, it is misclassified and must be either deleted or clarified and classified correctly.(cid:160)(cid:160)
`
`“Bags” must also be either deleted or clarified to indicate the type of bag and the appropriate class. (cid:160) For instance, vacuum cleaner bags are in
`International Class 007, knife bags are in International Class 008, computer bags are in International Class 009, bags for medical waste are in
`International Class 010, freezer bags are in International Class 016, all-purpose sports bags are in International Class 018, golf bags are in
`
`International Class 028, etc.(cid:160)(cid:160)
`
`“Books” must either be deleted or clarified to indicate the type of books and reclassified in International Class 016. (cid:160) Similarly, “journals” are
`
`classified in International Class 016 and must be clarified to indicate whether they are blank or what the journals are about.(cid:160)(cid:160)
`
`“Accessories” could include multiple items in many classes. (cid:160) Applicant must either delete this entry or clarify the type of accessories and
`
`classify accurately.(cid:160)(cid:160)
`
`Applicant has classified the following goods in International Class 025:(cid:160) canteens, flasks, mugs; furniture; leather cases, purses, wallets,
`backpacks; money clips, prints, art pictures, photographs; jewelry, cuff links; knives, branding irons; spurs.(cid:160) However, the proper classification
`
`for each item is as detailed in the suggested amendment language below.(cid:160)(cid:160)
`
`Therefore, applicant may respond by (1) adding one or more of the above international class(es) to the application, and reclassifying the above
`goods and/or services accordingly; or (2) deleting the goods in International Class 025 (identified above) from the application.(cid:160) See 37 C.F.R.
`§§2.86(a), 6.1; TMEP §§1403.02 et seq.(cid:160) If applicant adds one or more international classes to the application, applicant must comply with the
`multiple-class requirements specified in this Office action.
