`Specifically, the applicant’s mark is “ NPAID NON-PHARMACEUTICAL ANTI-INFLAMMATORY DEVICE” for “High frequency
`electromagnetic therapy apparatus.” (cid:160) The previously attached evidence shows the term “non” refers to “not” and “pharmaceutical” means “of
`or relating to pharmacy or pharmacists; a pharmaceutical product or preparation.” As such, the term “non-pharmaceutical” refers to something
`not of a pharmaceutical nature. Furthermore, the term “anti-inflammatory” refers to “preventing or reducing inflammation.” (cid:160) The term
`“device” means “an object designed and manufactured to perform one or more functions.” (cid:160) Please see definitions attached in initial Office
`action.(cid:160) Therefore, the wording merely describes the nature, feature and function of applicant’s goods. (cid:160) That is, applicant provides non-
`pharmaceutical devices that reduce/prevent inflammation.

`n its response applicant agrees to the disclaimer of “ANTI-INFLAMATORY”. (cid:160) However, applicant argues “that it takes an extraordinary effort
`of imagination for NON-PHARMACEUTICAL ANTI-INFLAMMATORY DEVICE to be understood as used on goods encompassed by the
`application.(cid:160) The mark in its entirety does not immediately call to mind such goods, and it is no more than suggestive of the goods in the present
`specification, rather than merely descriptive.” (cid:160) Applicant further argues that “[r]egarding the term NON-PHARMACEUTICAL in particular,
`Applicant respectfully submits that it was uniquely adopted for use in conjunction with mark’s other elements on or in connection with the listed
`goods, and that there are no other third party marks on the USPTO record that include the “NON-PHARMACEUTICAL” wording. (cid:160) This is
