`This FINAL Office action is being issued in response to applicant’s communication filed June 2, 2021. For the reasons outlined below, the
`Trademark Act Section 23(c) refusal is maintained and made FINAL. All arguments and evidence from prior Office actions are incorporated
`herein by reference.
`
`TRADEMARK ACT SECTION 23(C) - GENERICNESS
`
`Registration is refused on the Supplemental Register because the applied-for mark is generic and thus incapable of distinguishing applicant’ s
`services. Trademark Act Sections 23(c) and 45, 15 U.S.C. §§1091(c), 1127; see TMEP §§1209.01(c) et seq.
`
`The test for determining whether an applied-for mark is generic is its primary significance to the relevant public. Magic Wand Inc. v. RDB Inc.,
`940 F.2d 638, 641, 19 USPQ2d 1551, 1553-54 (Fed. Cir. 1991) (citing In re Montrachet S.A., 878 F.2d 375, 376, 11 USPQ2d 1393-94 (Fed. Cir.
`1989)). Making this determination involves a two-step inquiry:
`
`(1) What is the genus of goods and/or services at issue?
`(2) Does the relevant public understand the designation primarily to refer to that genus of goods and/or services?
`
`In re Cordua Rests., Inc., 823 F.3d 594, 599, 118 USPQ2d 1632, 1634 (Fed. Cir. 2016) (citing H. Marvin Ginn Corp. v. Int’] Ass’n of Fire
`Chiefs, Inc., 782 F.2d 987, 990, 228 USPQ 528, 530 (Fed. Cir. 1986)); TMEP §1209.01(c)(i).
`
`Applicant seeks to register the wording “FASHION WEBINAR” for use in connection with the following amended services: “Educational
`services, namely, providing classes, conferences, seminars, and workshops, non-downloadable webinars and podcasts, and field trips, all in the
`fields of small business development, personal growth, and entrepreneurship, and distribution of training material in connection therewith;
`Educational and entertainment services, namely, providing motivational and educational speakers; Personal coaching services in the field of
`Life/work balance; Personal coaching services in the field of Advertising, branding, business development, and business management; Providing
`group coaching in the field of Life/work balance; Providing group coaching in the field of Advertising, branding, business development and
`business marketing”.
`
`Regarding the first part of the inquiry, the genus of the services may be defined by an applicant's identification of services. See In re Cordua
`Rests., Inc., 823 F.3d at 602, 118 USPQ2d at 1636 (citing Magic Wand Inc. v. RDB Inc., 940 F.2d at 640, 19 USPQ2d at 1552); see also In re
`1800Mattress.com IP, LLC, 586 F.3d 1359, 1361, 1363, 92 USPQ2d 1682, 1682, 1684 (Fed. Cir. 2009).
`
`In this case, the application identifies the services as “Educational services, namely, providing classes, conferences, seminars, and workshops,
`non-downloadable webinars and podcasts, and field trips, all in the fields of small business development, personal growth, and entrepreneurship,
`and distribution of training material in connection therewith; Educational and entertainment services, namely, providing motivational and
`educational speakers; Personal coaching services in the field of Life/work balance; Personal coaching services in the field of Advertising,
`branding, business development, and business management; Providing group coaching in the field of Life/work balance; Providing group
`coaching in the field of Advertising, branding, business development and business marketing,” which adequately defines the genus at issue.
`

`Regarding the second part of the inquiry, the relevant public is the purchasing or consuming public for the identified services. The Loglan Inst.
`Inc. v. The Logical Language Grp., 962 F.2d 1038, 1041, 22 USPQ2d 1531, 1533 (Fed. Cir. 1992) (quoting Magic Wand Inc. v. RDB Inc., 940
`F.2d at 640, 19 USPQ2d at 1553). In this case, the relevant public comprises ordinary consumers who purchase applicant’s services, because
`there are no restrictions or limitations to the channels of trade or classes of consumers. The attached evidence from Business Summits, DHL,
`EndHumantrafficking.com, Temple University, 360 Creative Innovation Hub, and K&L Gates shows that the wording “FASHION WEBINAR”
`in the applied-for mark refers to a “live online educational presentation during which participating viewers can submit questions and comments”
`in the field of fashion, which includes business issues in the field of fashion.
`
`The attached evidence from 360 Creative Innovation Hub, K&L Gates, Fashion Frameworks, American Mobile Retail Association, and DHL
`shows that fashion webinars include webinars related to the business of fashion. A pplicant’s services involve the provision of webinars related to
`the business of fashion. Therefore, the wording “FASHION WEBINAR’ is generic for services involving the provision of webinars in the field
`of business related to fashion, and the relevant public would understand this designation to refer primarily to that genus of services because the
`basic definitions of the words in the mark have that meaning, and the attached evidence demonstrates that webinars in the field of fashion
`encompass webinars related to fashion business.
`
`Applicant argues that the applied-for mark “FASHION WEBINAR” “denotes a media experience - i.e., an online seminar... [and]does not
`denote the services that Applicant provides are educational or coaching-based in nature”. Applicant’s Response to Office Action, TSDR, p. 3.
`However, applicant’s Facebook® page confirms that its webinars related to the business of fashion. See attached. The Facebook® page states:
`“This webinar is beneficial to boutique owners, fashion designers and private-label brands”. It also describes the webinar as “our Fashion
`Webinar series for Retailers!” An applicant’s website may assist in clarifying or refining the genus by providing the context for the terms in the
`identification. In re Reed Elsevier Props. Inc., 482 F.3d 1376, 1379, 82 USPQ2d 1378, 1380 (Fed. Cir. 2007); In re Katch, LLC, 2019 USPQ2d
`233842, at *3 (TTAB 2019) (quoting In re DNI Holdings Ltd., 77 USPQ2d 1435, 1439 (TTAB 2005)).
`
`Thus, the genus of applicant’s services involve the provision of webinars in the field of fashion business, including small business development,
`personal growth, entrepreneurship, the provision of motivational and educational speakers, and personal coaching services in the field of
`advertising, branding, business development, and business management, all in the field of fashion. Therefore, the wording “FASHION
`WEBINAR” immediately refers to the type of services being provided and is generic.
`

`organization featured here on the show, and you've also heard about some of the fair
`trade fashion shows that Live2Free has hosted over the years. Well, this year has a bit
`different. Right. We have COVID in our midst. And so we're doing some new things than
`we've done before. And we wanted to let you know about it because there's an
`opportunity to get involved online and connect with some of the great work that
`Live2Free is doing. | am so glad to be able to welcome back a voice you have heard
`many times on the show. Ruthi Hanchett. She is the Live2Free coach here at Vanguard
`University of Southern California and also on the board here of the Global Center for
`Women of Justice. Ruthi, so glad to see you again.

`this year because everything's virtual.

`Ruthi [00:01:09] Yeah, it’s, you know, a blessing in disguise, if we can call it that,
`because, well, we have had to make some major changes because of the global
`pandemic. It does open up some opportunities in that we have this opportunity to
`expand our fashion show to include many people that may not physically have
`otherwise been able to come. So, as you mentioned, we have been able to host a fair
`trade fashion show for the last five years or this will be our fifth year. And it’s a great
`opportunity for our students to show us what they're learning and how they're growing
`and understanding about not only slave trafficking and slave labor, but really the impact
`we can have as consumers when we choose to buy more ethically sourced products.
`So normally we have a really fun celebration of fair trade, fashion, and ethically sourced
`products with all kinds of students walking the runway. Community members that come
`and participate. But this year we've had to shift. And because of that, we're putting it all
`online. We're going to have a virtual fair trade celebration. And thal means thal anyone
`can participate by joining us on Zoom webinars and also participating in some really fun
`fashion challenges that we've planned for these two weeks of November.
`

`involved with this, the president of Live2Free.

`Alexandrea Hurst, Alie is an amazing leader of her peers. And she and her team have

`student team this year has created a two-week celebration of fair trade fashion. We're
`going to have two social media challenges that will each run for one week and have
`three prize winners at the end. So for a total of six prize winners and in addition to that,
`we'll be hosting three webinars that you can join and view from all over the world. So
`we'll have a conversation on Fair Trade Fashion Webinar with different panelists and
`guest speakers that work in the fair trade community. We'll also have affordable, fair
`trade shopping for young adults, which will be student-led, student put together, meant
`to help young adults know how they can shop fair trade without breaking the bank. And
`then we'll have for our finale webinar exploring local fair trade, where we'll be
`incorporating vendor participation and sending students physically to storefronts to tune
`into one webinar. And you can see what fair trade looks like in Orange County.

`for those who would like to participate. What's the best way to connect and learn about
`all the different dates and links to get Involved?

`and really get hands-on with the issue. We'll have a thrifted an ethical challenge on
`social media, which would be a great chance for you to recycle old clothes, to go out
`into the community, and find things you maybe weren't looking for before. So | just want
`to encourage anyone listening to really anywhere around the world get hands-on with
`this and get involved, because this is a great opportunity to learn about the issues.

`Ruthi [00:06:43] | am so proud of the students and the way that they've taken really a
`huge challenge and a difficult situation and made something super positive out of it. And
`what | love is that when we purchase fair trade or when we support these small vote
`talks that are selling fair trade items, we are also building the economy and supporting
`individual artisans around the globe. And right now, we know Covid-19, has so many
`people so hard and this is a way to support people and pay them for their labor. So it's a
`great way to celebrate and make a difference to affect fighting human trafficking. And
`learn and have fun with it.
