`On 3/‘2/ 12 @ approximately 10:50am. I received a call from M18 1, M. Donofrio and he told
`me that P. Woitovich had an accident while inspecting a vent bay at 14th St. He informed me that
`Mr. Woitovich had fallen into the vent bay when the ladder he was descending gave way. He also
`informed me that he had called for emergency services.
`I immediately notified G. Supt. E. Ventura and responded to the scene. Upon arrival at the
`scene, '1 was informed by W. Pisciotta, Supt. ICC, that EMS had just taken Mr. Woitovich to
`Bellevue hosPital, and that W3 1, M. Donofrio had accompanied him.
`1 took photos of the area and interviewed M/S 1, Pollidoro (ICC) who was at the scene when
`the accident occurred. He informed me that a ladder had been placed into the vent bay and when
`Mr. Woitovich began to descend, the ladder slipped away causing Mr. Woitovich to fall. During my
`investigation I noticed that there was oil and grease present ontop of the vent grating as well as in
`the bottom of the vent where the ladder was. (photos attached).
`I then proceeded to Bellevue hospital to meet with Mr. Woitovich and Donofrio. Upon
`arrival, I was informed that Mr. Woitovich had suffered 2 broken heels. I interviewed Mr.
`Woitovich, and filled out the accident forms (attached).

`“movants") move, pursuant to CPLR 3212, for an Order granting them summaryjudgment dismissing the Complaint
`and any and all cross-claims asserted against them and for summary judgment on 14‘h Street’s cross claim against
`defendant Trihop 14‘h Street, LLC ("Trihop") for contractual indemnification.
`
`Factual and Procedural Background
`
`The underlying action was brought by Plaintiff, Paul Woitovich, for alleged personal injuries which he sustained while
`performing work below the sidewalk in front of 235 East 14‘" Street, New York, New York while on a ladder inside a
`subway airway shaft on behalf of third-party defendant, New York City Transit Authority (“NYCTA”). Plaintiff served the
`original Summons and Complaint on the City of New York on or about May 16, 2013.
`
`On or about June 10, 2013, Plaintiff served a Supplemental Summons and Amended Complaint naming, inter alia,
`movants herein and defendant Trihop. Plaintiff claimed that he was injured, inter alia, as a result of violations of Labor
`Law sections 240(1) and 241(6) and due to common law negligence.
`Issue wasjoined by movants herein on or about
`July 24, 2013.
`In addition to their answer, movants asserted cross-claims inter alia, against Trihop for contribution,
`common—law indemnification, contractual indemnification and breach of contract forfailure to procure insurance. By
`verified answer dated January 4, 2014, Trihop joined issue and asserted cross—clams inter alia, against movants for
`contribution, common-law indemnification and contractual indemnification.
`
`The instant motion for summary judgment, pursuant to CPLR 3212, dismissing the Complaint and any and all cross-
`claims asserted against movants and forsummaryjudgment on 14m Street's cross-claim against defendant Trihop 14m
`Street, LLC, (“Trihop"), for contractual indemnification was filed on or about November 23, 2015.
`
`Movants note that it is uncontroverted that the sole purpose of the airway shaft is to provide fresh air into NYCTA’s

`bottom of the airway shaft, He further testified that, as he was lying on the ground after his fall, he observed grease
`and particles of pancakes on the bottom of the airway shaft. See Exhibit A, plaintiff‘s EBT, at pages 86-87.
`
`Movant 14m Street is the owner of the mixed—use building located at 235 East 14m Street. Movant AAC was mistakenly
`named in the action, and has no relationship to the building. The actual management company forthe subject building,
`is non-party Marin Management Company. See Exhibit D, Hodzic EBT, at p. 14.
`
`Defendant Trihop leased the ground floor of the subject building, where it operated an IHOP restaurant. See Exhibit
`F, Scannapieco EBT, at pp 10, 127-128; and Exhibit G, lease agreement. Scannapieco, the Director of Operations
`for Trihop, testified that, on the day in question, Trihop had placed its garbage over the subway grates that covered
`the airway shaft, See Exhibit F, Scannapieco EBT, at pp. 39, 55-56, 59, 61, 68-69, 94. He further testified that the
`placement of the garbage bags was done under the direction and supervision of Trihop. Id, at pp. 39, 55-56, 59, 61,
`68-69, 94.
`
`Movant, 14‘" Street, also notes that the testimony of its superintendent, Osman Hodzic, is uncontroverted and that
`that he testified that he placed the movant’s residential garbage in front of the adjacent building at 231 East 14m Street
`and that there is no subway grate in front of 231 East ‘I4m Street. Hodzic further testified that he placed the garbage
`there because he was responsible for the residential garbage at that building. See Exhibit D, Hodzic EBT, at pp. 25-26,
`30, 63-64.
`
`Finally, with respect to indemnification, 14'“ Street cites section 11.03 of the lease agreement, between itself and
`Trihop, which requires Trihop, as tenant, to indemnify 14‘" Street, as landlord, for“all claims, actions, damages, liability,
`cost and expenses, including attorney’s fees, in connection with all losses, including loss of life, personal injury and/or
`damage to property...occasioned wholly or in part by any act or omission of Tenant..." See Exhibit F.
`
`Plaintiff and co-defendants, including named co-defendant herein, Trihop, do not oppose the motion despite being
`served with the same. After a review of the papers presented, all relevant statutes and case law, this Court grants
`the motion.
`
`Movants’ Position
`
`Movants assert that they are entitled to summary judg ment dismissing the complaint and all cross claims against them.
`First, they argue that they are not subject to liability pursuant to Labor Law sections 240(1) or 241 (6) because they are
`not owners or contractors, They further assert that they owed no common law duty of care to plaintiff because the City
`of New York owned the airway shaft where plaintiff was injured. Upon dismissal of all direct claims against them, argue
`movants, they are entitled to the dismissal of all cross claims against them, Finally, 14‘" Street urges that it is entitled
`to summaryjudgment on its claim for contractual indemnification against Trihop.
`
`Conclusions of Law:
`
`Labor Law section 240(1) imposes liability on premises owners and contractors for certain elevation-related risks and
`the failure to provide adequate safety devices to protect against the same. See Keenan v Simon Properties Group, Inc,
`106 AD3d 586 (15‘ Dept 2013). Labor Law section 241(6) imposes a nondelegable duty on owners and contractors
`to provide reasonable and adequate safety to workers. See Ross v Curtis-Palmer Hydro-Elect Co., 81 NY2d 494
`(1993). Here, movants established prima facie that they were not owners pursuant to Labor Law sections 240(1) and
`241(6), See Matter of91Si St. Crane Collapse Litig., 112 AD3d 477 (1S1 Dept 201 3); Grilikhes v International Tile & Stone
`Show Expos, 90 AD3d 480 (1 5‘ Dept 201 1 ). Further, they established that they did not contract for the work performed
`by plaintiff, as the NYCTA was undertaking the project. See Ex. A, Plaintiffs EBT, at 28, 35; Ex. L, Wisell Aff., at par.
`6, See Chang Zhang Zou v 122 Dev., LLC, 103 AD3d 519 (15‘ Dept 2013).
`
`Movants established their prima facie entitlement to the dismissal of plaintiffs claim pursuant to Labor Law section 200,
`which sets forth a landowner’s common law duty to provide a safe place to work, since they showed that they '
`“exercisejdj no supervisory control over the operation" in which plaintiff was allegedly injured. Yong Ju Kim v Herbert
`Constr. Co., 275 AD2d 709, 712 (2d Dept 2000). Specifically, Hodzic testified that he placed the garbage for 235 East
`14th Street in front of 231 East 14'“ Street in an area where there was no subway grate. See Ex. D, Hodzic EBT, at 25-
`26, 30, 6354. Further, the City was the “undisputed owner" of the airway shaft where the alleged incident occurred.
`See Ex, K, Wisell Aff., at par. 2; Ex. B, Rodriguez EBT, at 19-21, 24; Ex. C, lease.
`
`Given their freedom from any negligence in this matter, movants are entitled to summary judgment dismissing the
`cross claims against them for contribution and common-law indemnification. See McLaughlin vAnn-GurRea/ty Corp,
`107 AD3d 469 (1‘I Dept 2013); Stallone v Plaza Constr. Corp, 95 AD3d 633 (1“ Dept. 2012),

`pursuant to which they agreed to indemnify any other party-to this action. See Hughey v RHM-88, LLC, 77 ADsd 520
`(1“ Dept 2010),
`
`Finally,14m Street has established its prima facie entitlement to summary judgment on its claim seeking contractual
`indemnification from Trihop. As noted above, the lease between Trihop, as tenant, required it to indemnify 14"‘ Street,
`as landlord, for any damages, including costs, expenses, and attorneys‘ fees, arising from any act or omission by
`Trihop. See Exhibit F. Thus, the intention of the parties is clearly implied from the agreement. See Torres v LPE Land
`Dev. & Constr., Inc., 54 AD3d 668, 670 (2d Dept 2008). Scannapieco, the Director of Operations for Trihop, testified
`that, on the day in question, Trihop had placed its garbage over the subway grates that covered the ain/vay shaft. See
`Exhibit F, Scannapieco EBT, at pp. 39, 5556, 59, 61 , 68-69, 94. He further testified that the placement of the garbage
`bags was done under the direction and supervision of Trihop. Id., at pp. 39, 55-56, 59, 61, 68—69, 94. Since 14m Street
`proved itself free from any wrongdoing, it is entitled to summary judgment awarding it costs and attorneys‘ fees on its
`claim for contractual indemnification against Trihop. Cf., Cave Constr. CO, Inc. v Gealtec Remodeling Corp, 58 ADad
`660 (2d Dept 2009).
`
`Therefore, in accordance with the foregoing, it is hereby:
`
`ORDERED that the branch of the motion for summaryjudgment by defendants 235 East 14m Street Realty LLC and
`AAC Management Corp. seeking dismissal of the complaint and all cross claims asserted against them is granted,
`without opposition, and the complaint and all cross claims are dismissed against those defendants, with costs and
`disbursements to the movants as taxed by the Clerk upon the submission of an appropriate bill of costs; and it is
`further;
`
`ORDERED that the branch Of the motion which seeks an order granting defendant 235 East 14‘h Street Realty LLC
`summary judgment on its claim for contractual indemnification against defendant Trihop 14m Street LLC is granted,
`without opposition; and it is further,
`
`ORDERED that the issue of the amount of 235 East 14‘h Street Realty LLC’s costs, disbursements and attorneys' fees
`it is owed by Trihop 14m Street LLC is referred to a Special Referee to hear and report with recommendations, except
`that, in the event of and upon the filing of a stipulation of the parties, as permitted by CPLR 4317, the Special Referee,
`or another person designated by the parties to serve as referee, shall determine the aforesaid issue; and it is further,

`of entry, together with a completed information sheet, upon the Special Referee Clerk in the Motion Support Office,
