`Conduct of the Proceeding
`37 C.F.R. § 42.5
`

`
`
`Case IPR2015-01263
`Patent 8,896,447
`
`
`
`Hangzhou Langhong Technology Co., Ltd. and Langhong Technology USA
`
`Inc. (collectively, “Petitioner”) submitted a Petition for inter partes review of U.S.
`
`Patent No. 8,896,447 B2 (the “Subject Patent”). During a telephone conference on
`
`July 8, 2015, we advised counsel that, although the Petition submitted on May 22,
`
`2015 was accompanied by eight Exhibits, because Petitioner did not include as an
`
`exhibit a copy of the Subject Patent, a corrected Petition was required to obtain a
`
`filing date. A petition for inter partes review must include the exhibit number of
`
`the supporting evidence relied upon to support the challenge, including identifying
`
`specific portions of the evidence that support the challenge. 37 C.F.R. § 42.104(5).
`
`The petition must also identify the challenged claim and state how the challenged
`
`claim is to be construed. 37 C.F.R. § 42.104(2),(3). Thus, a copy of the Subject
`
`Patent is required for the Petition to receive a filing date.
`
`On July 16, 2015, we ordered that a corrected Petition with a copy of the
`
`Subject Patent be submitted within five days, or the Petition would be denied a
`
`filing date and dismissed.
`
`A corrected Petition has not been submitted. Therefore, the Petition has not
`
`been accorded a filing date and the Petition is dismissed.
`
`In consideration of the above, it is
`
`ORDERED that the Petition is DISMISSED.
